 1. Background information.

 

The report entitled «A principled basis for a just and lasting Cyprus settlement in the light of International and European Law», attached herewith (two word files are attached, one in English and another in Greek), is the outcome of a collective endeavor which begun in 2004 after the rejection of the Anan plan by the majority of Cypriots and completed in early autumn 2005. This effort begun in the context of the deliberations of the “Scientific Committee for a European solution of the Cyprus question” created by the “Panhellenic Association for a European Solution of the Cyprus question”. The members of the “Scientific Committee” were Professor George Kassimatis who presided the deliberations, the professors of Panteion University Stelios Perrakis, Panayiotis Ifestos and Christodoulos Giallourides and Perikles Nearchou, former diplomatic adviser to the Prime Minister. Members of the “International Association for the protection of Human Rights in Cyprus” also cooperated with the Committee.

            Eventually, the “Panhellenic Association for a European Solution of the Cyprus question” convened the “International Expert Panel” comprised of experts in International law, constitutional law, European law, international relations and political science. Their report was finalized in August 2005 and handed over to the leadership of the two communities, to the President of the Republic of Cyprus and to the leaders of the political parties in Cyprus. The report was presented publicly in press conference in Nicosia on September 1st. It was also dispatched to the head of Governments of the EU, to the institutions of the EU and to many other potentially interested institutions in Europe.   

            At the outset, a primary objective was to confine the debates on the Cyprus question in scientific boundaries, thus excluding inputs of ideological, political, partisan and national or other value laden criteria. This could only be achieved if the Cyprus question is considered in terms of international and European rule of law, that is, in terms of mandatory-obligatory legal terms which if duly respected and fully implemented the Cyprus problem, it is believed, could be solved immediately and in the interests of all parties involved.

 

2. Political theory, power, causes of war and international rule of law

 

Given that elementary criteria of scientific objectivity are respected, a political scientist could easily define and delimit international and European rule of law. International and European rule of law is explicitly if not precisely recorded, inter alia, in international conventions, in the charters of the international institutions and in internal legal order of states. [«The rule of law in international law provides that all official activities must be undertaken in a way that is consistent with legal principles. It further means that legal processes must be established and respected in order for legal principles to operate effectively, so that, for example, the principle of due process is critical. As previously noted (paragraph 15), both the Council of Europe and the European Union are founded upon inter alia the principle of the rule of law. 26. There can be no international rule of law in a territory illegally occupied by a foreign power. Indeed, the fact that a member state of the European Union is prevented from exercising its sovereignty over part of its internationally recognised territory challenges the reality of the European rule of law itself». See para. 25,26 of the attached report]

            Shortly stated, to the extend that almost all states entangled in the Cyprus question participate in numerous international organizations and signed various conventions whose clauses are incorporated as mandatory law in their internal judicial system, their governments are legally bounded in their behavior and decisions.

            At this point, it is important to draw the borderline –unfortunately not always obvious for many– between the issues of international politics which are conditioned by the aforementioned mandatory-(strictly obligatory) international legal agreements and other issues which are directly influenced by power and the many causes of war so well described and explained by authors of the analysts of the traditional Paradigm such as Thucydides, Gilpin, Aron and Waltz. In fact, the former, that is, the obligatory-mandatory legal commitments of states at the international level constitute what one may define as “the acquisitions of humans’ political civilization at the international level” whilst the latter are –unfortunately– conditioned by power and the cause of war and are by and large the principal source of great human hardships. Some additional points as regards this important distinction are necessary.

            Firstly, epistemologically speaking, it is a fact that many thinkers trained to be international politics “specialists” –and a great number of “invaders” of adjacent scientific fields– in the anarchically developing “scientific” field of “international relations”, often create a chaos of irrational political assessments springing from the overflowing of value laden “judgments” (pseudo-)scientifically disguised. In fact, the field could progress considerably if its specialists do not confuse what is obligatory in the involved states’ internal normative structures with other issues which are by and large influenced by interstate disagreements, by power politics and by the broader causes of war at the international level. Unless IR analysts comprehend fully the ontologically founded fundamental characteristics of the interstate system based on the principle of state sovereignty (and its corollary international anarchy) and the real nature of the causes of war, they are condemned to oscillate shakily and inconsistently between cosmopolitan nonsense, “idealistic” hegemonic rationalizations and sterile legalism. The publicly taken positions of many on the Anan plan reflect precisely this predominant pitiful state of affairs in the IR community of Greece (and certainly of the other scientific communities of Europe and elsewhere).

            Secondly, though Cypriots themselves, mainland Greeks, mainland Turks and British leaders are all directly concerned by the Anan plan, its adventures during the period 2001-2005 are of broader significance. Its drafting and presentation exemplify the deficiencies of international organizations, highlight the fact that the causes of war are alive and actively undermining the foundations of the interstate system and explain the reasons of the difficulties to implement fully the rule of law in international relations.

            Thirdly, the adventure of the Anan plan could prove the most appropriate case study as regards contemporary international relations, the state of the art of IR theory, the functioning of international institutions, the causes of war of the post-World War Two era and the “changes” in the post-Cold War era. It is certainly a severe testing ground of the state of affairs of contemporary political theory in Europe and elsewhere. Anan plan could prove the Waterloo of many political theorists if not of modern political theory itself, its proclaimed scientific ethics and its ability to explain the ontologically founded Paradigm of anarchy-sovereignty [Admirably described by Thucydides but still deprived of “political philosophy of international relations” and clear thinking as regards the dilemmas owing to the challenges of modern times, especially of the challenges of the societies’ ever deepening claim for political sovereignty (that is, the claim for national independence of those societies whose representatives respect rule of law in international relations)]. Lets be straight regarding this point: To the extend their writings were corrupted by value laden criteria resulting to an unacceptable bias in favor of the –legally and politically speaking–, monstrous Anan plan, the overwhelming majority of political scientists in Europe did not honor basic and elementary epistemic premises which could secure political theory’s compatibility with the acquisitions of human civilization at the international level. Many applauded the violation of international and European rule of law and co-advocated claims of some western powers which tend to reverse political civilization back to the colonial age. At the same time, many normatively –to my view owing to scientific-logical errors or political hypocrisy– “idealistically” claim to serve “Europe”, “human rights”, “international law”, “peace” etc. As Edward H. Carr substantiated long ago, the one or the other way they are in the service of disguised hegemonic claims.

 

3. The final report of the “International Expert Panel convened by the Committee for a European Solution in Cyprus”           

 

The final report of the “International Expert Panel convened by the Committee for a European Solution in Cyprus” was indeed no easy task. I would like, however, to register the fact that my faith for scientific objectivity and the fundamentally ecumenical character of political science is strengthened. During the many scientific meetings that took place in 2004 and 2005 and to which I participated, it became clear that among political scientists engaged in the search of scientific truth, there is indeed a lot of common ground. Irrespective national, ideological, political or partisan criteria of the analysts when they attempt to describe interstate rule of law, it is indeed feasible to describe-define international normative structures as they were overtime agreed and established by the sovereign states. In fact, this was one more experience that strengthened my conviction that mandatory-obligatory normative structures at the international level could both provide a basis for productive international relations theory bridging the various branches of social sciences and a borderline of serious scientific as well as political debate on the problems owing to the cause of war. Certainly as it is stressed below, it could provide an ethical basis of IR analysis and political thinking.

            The attached report of the International Experts panel, on purely objective grounds owing to the legal-political commitments the states themselves made in the past, provides a realistic orientation for a viable solution of the Cyprus question in a way that benefits all its inhabitants and serves peace and stability in the area.

[NB. In earlier writings –see for example my latest monograph http://www.ifestos.edu.gr/7.htm)– this author, inter alia, attempted to establish i) that the Paradigm of Sovereignty-Anarchy is ontologically founded, ii) that the societies’ claim for collective political sovereignty is the nearest equivalent to “freedom” in international relations, iii) that –as it is defined with precision by the fundamental principles of international law which are by their nature anti-hegemonic– the claim for political sovereignty-collective freedom, is an overarching criterion of interstate relations, ontologically founded and for that reason morally irrebuttable, iv) that if international rule of law is respected for all “peace loving societies-states” –as defined in the aforementioned study– their statehood is their “collective freedom institution” («θεσμός ελευθερίας»-“thesmos eleftherias”) and v) that full respect of international rule of law and international peace and stability could only advance if the causes of war are eliminated or substantially moderated. Basically, value free IR studies of Traditionalist analysts differs from IL analysis only to the extend the former examine and consider appropriately the existence of the causes of war in contemporary international politics. Last but not least, as regards the debates on analytical ethics and international morality, all analysts and politicians could very well take into the account the existence of an ontologically founded overarching basis, that is, ”international rule of law” as previously defined. Political sovereignty of peace loving states and its corollary “socially defined” international institutions (whose principal “mission” is the safeguard of the collective freedom of the sovereign societies) are the basis of both value free analysis whish is compatible to scientific ethics founded on interstate ontology. They also provide the ethical and political basis of peaceful resolution of international conflicts and peaceful interstate cooperation. Political sovereignty defined as collective freedom, in other words, is a sound value free ethical orientation in both IR analysis and interstate politics.]      

 

4. Call for endorsement of the report

 

Bilingual readers would notice that the English report and its Greek translation are identical. French and German language versions are under preparation. It is expected that many more specialists of international law, European law and international relations would add their names to the ones who finalized it and already signed it. Moreover, to the extend this report is the product of a collective effort and given that it is already published, it could be consider as an acquisition of political theory and as a reference text of everyone interested in the Cyprus question.

            In fact a list of scholars is created for everyone wishing to publicly endorse its scientific content [endorsements could be sent electronically to the address (click) “I endorse the report A principled basis for a just and lasting Cyprus settlement in the light of International and European Law” and it would be promptly appropriately forwarded]. At this point, may I make it clear that an endorsement of this kind has nothing to do with politically and ideologically loaded lists of heterogeneous signatories. Simply, it is an endorsement of the report’s scientific content by all scholars who would agree with the validation and substantiation it provides.

 

Lastly, everyone agreeing with its content and disposing an electronic list, could circulate the report or forward it for publishing in web pages or in other available media.

 INTERNATIONAL EXPERT PANEL

CONVENED BY

THE COMMITTEE FOR A EUROPEAN SOLUTION IN CYPRUS

 

A principled basis for a just and lasting Cyprus settlement in the light of International and European Law

 Preamble

1.         The purpose of this Report, prepared by an International Expert Panel, is to seek a just Cyprus settlement providing for the peaceful and prosperous future of all the people of the island. In order to do this, one must apply the key principles drawn from international and European law which apply in the settlement of international disputes, including disputes concerning members of the European Union. Such principles lie at the heart of international and European law. Failure to respect such principles is likely not only to prejudice the success of any particular settlement plan by internalising contradictions with international law and thus weakening its sustainability, but also to constitute a destabilising element for the future. The precedent of a political settlement contrary to accepted international and European legal principles may well be resorted to in other dispute situations with serious consequences for the stability of the international order.

 

2.         The fundamental principles of international and European law offer a unique guide and methodology by which to initiate and successfully conclude a process leading to a Cyprus settlement within the framework of a new and genuinely Cypriot Constitution in accordance with the right of self-determination. This is at the very core of a European solution for Cyprus, consistent with international and European law.

 

3.         The solution of the Cyprus problem must be found by respecting and applying the fundamental principles on which international law and the European Union are founded: these are in brief, the peaceful settlement of disputes; the sovereignty, independence and equality of states; the prohibition of aggression and the non-recognition of its consequences; and respect for human rights, liberty, democracy and the rule of law. Both the present state of affairs in Cyprus and the terms of the current Annan Plan are inconsistent with these fundamental principles. It is also essential to arrive at a solution that fully respects the need for the reconciliation of, and cooperation between, the communities and all relevant parties.

 4.         The European Union is called upon to seize this historic opportunity and to assume its special responsibility for actively helping to put in motion a process of constitution-making that will finally allow the Republic of Cyprus, as a member state, to recover full sovereignty and independence and to establish peacefully a constitutional order respecting the above mentioned principles, and based on full respect for diversity.

 Basic facts

5.         The Republic of Cyprus came to independence in 1960 by virtue of a series of international agreements. However, unlike other decolonised territories, it was subject to Treaty of Guarantee provisions in favour of the United Kingdom, Turkey and Greece. In 1974, Turkey, invoking the coup by the Greek Junta against the legitimate Cypriot government of Archbishop Makarios, invaded and proceeded to occupy northern Cyprus. This initial action, however, hardened into a prolonged and continuing occupation which has now continued for over 30 years and which has involved a series of human rights violations as attested by the organs of the European Convention of Human Right.[1] Since 1974, Cyprus has been  de facto divided into the Republic of Cyprus recognized by the international community and the “Turkish Republic of Northern Cyprus”, an entity[2] declared invalid by UN Security Council resolutions 541 (1983) and 550 (1984) and recognized and sustained only by Turkey. While roughly half of the Turkish Cypriot community has emigrated since the 1974 events, mainly to the United Kingdom, more than 120,000 Turkish settlers are now living in northern Cyprus, transforming the Turkish Cypriots into a minority within their own constituency. The population of Cyprus at present (settlers apart) is 802,500 of whom some 80% are Greek Cypriots, 11% are Turkish Cypriots (this figure was 18% in 1974) and 9% are Armenians, Maronites, Latins and alien residents.

6.         The Annan Plan as presented in its final version by the Secretary General of the United Nations on 31 March 2004 provided for a federal state, the “United Republic of Cyprus”, replacing and abolishing the existing Republic of Cyprus and incorporating the occupied northern area. On 24 April 2004, two separate referendums were held. While 65% of the Turkish Cypriot and settler voters in the occupied north accepted the Annan plan, 76% of their Greek Cypriot counterparts in the Republic of Cyprus rejected it. On May 1st, 2004, the Republic of Cyprus as a whole became a member state of the European Union. An Additional Protocol to the Treaty of Accession provided for the temporary suspension of the acquis communautaire in the occupied areas. Negotiations on Turkey’s accession are about to start.

The Fundamental Principles

1.      The Peaceful Settlement of Disputes

a) The Meaning of the Principle

7.         Article 2 (3) of the United Nations Charter provides that; “All members shall settle their international disputes by peaceful means in such a manner that international peace and security and justice are not endangered”. Accordingly, a settlement that does, or appears likely to, endanger international peace and stability and is inconsistent with accepted standards of justice cannot be consistent with the obligations upon all states laid down in the Charter.[3]

b) Annan Plan Deficiencies

8.         The terms of the Annan Plan would in fact have embedded instability into the heart of a Cyprus settlement and would inevitably have led to increasing friction and destabilisation. This is underlined by the provisions concerning the position of foreign nationals with effective control over key areas of governmental activities in Cyprus. Examples where non-Cypriots would (in the event of disagreement between the equal numbers of Greek and Turkish Cypriots) have effective control appeared to include the Reconciliation Commission; the Supreme Court invested with legislative and executive powers; the Central Bank; the Relocation Board; the Property Court and the organs of the Property Board. Bearing in mind the experience of the period 1960-63, the need for stability in the ordering of governmental activities is critical. Further, the foreign nationals concerned would not be democratically accountable to the people of Cyprus.

9.         Any settlement of an international dispute must also be in accord with justice. This point is noted below (paragraph 15) in relation to the fundamental principle of respect for human rights.

2.      The Sovereignty, Independence and Equality of States

a) The Meaning of the Principle

10.       International law, as well as EU law, is founded upon the recognition of independent and sovereign states. Consequential principles include the obligations of non-intervention in the internal affairs of states and respect for the territorial integrity of all states.[4] In addition, the right of self-determination provides that while people within a state have the right to participate in the governance of that state, the free choice of the people of a state, conforming to fundamental international and European values must be respected on the international level.

 b) Annan Plan Deficiencies

11.       The Annan Plan is founded upon the abolition of the legitimate and recognised Republic of Cyprus. Further, the right of intervention in the internal affairs of Cyprus, reserved to Greece, Turkey and Great Britain as the Guarantor Powers according to the Treaty of Establishment of 16 August 1960 and extended in the Annan Plan to cover the territorial integrity, security and constitutional order of both the federal “United Cyprus Republic” and the constituent states, constitutes a significant limitation on the sovereignty and independence of Cyprus and a challenge to the international and European legal orders. This was underlined by the proposed creation of a Monitoring Committee, composed of representatives of the guarantor powers, the constituent states and the UN, to monitor the implementation of the Annan Plan settlement and with the power to make recommendations. Furthermore, the Annan Plan provided for the permanent demilitarisation and disarmament of the new Cypriot state, thus raising questions as to the right to self-defence.

 

12.       In addition, one notes under the Annan Plan the right of the UK to complete and unimpeded access for any purpose whatsoever to the waters between the Sovereign Base Areas’ waters and the fact that international judicial or third party settlement procedure is expressly forbidden with regard to disputes concerning the Sovereign Base Areas. Such disputes were to be resolved by an arbitrator appointed by the authorities of the Sovereign Base Areas.

 

  1. The Prohibition of the Act and Consequences of Aggression

a) The Meaning of the Principle

13.       The prohibition of aggression is at the heart of the international legal order. It is enshrined in international law in general terms,[5] in international criminal law,[6] and with regard to specific situations. Prohibiting the consequences of aggression means rejecting the benefits obtained as a result of illegal aggression and is enshrined, for example, in the jus cogens norm of the non-acquisition of title to territory as a result of aggression. In the context of Cyprus, the UN Security Council adopted resolutions 541 (1983) and 550 (1984) declaring the purported “Turkish Republic of Northern Cyprus” to be illegal and calling upon all states not to recognise it.[7] Further, the implantation of settlers from Turkey in an attempt to manipulate the demography of the island of Cyprus runs counter to the principles of international law, especially those relating to self-determination and human rights. In particular, Article 49 of Geneva Convention IV on the Protection of Civilian Persons 1949 (ratified by both Cyprus and Turkey) prohibits the transfer by an occupying power of part of its own civilian population into the occupied territory. It should, of course, be noted that, having established the illegality of the position of the settlers, the question of the future of the settlers and their families is a separate matter to be determined by the parties concerned within the framework of an overall just and fair settlement and in a manner consistent with international and European law.

 

b) Annan Plan Deficiencies

14.       The Annan Plan provided for the legitimisation of acts of the “TRNC” and by extension of the “TRNC” itself. The Plan declared that all acts of any authority on the island of Cyprus (excluding the Sovereign Bases Areas) would be recognised as valid unless the particular act at issue was inconsistent with international law, irrespective of the question of the status of the authority in question. Equally seriously, the provisions of the Plan in relation to the settlers from Turkey were hardly consistent with international law.[8] First, the Plan permitted the settlers to vote in the Turkish Cypriot referendum, even though the former now constitute a majority of inhabitants of the north and even though this recognised as a decisive constitutional force an illegal consequence of an illegal aggression. The UN has not envisaged settlers voting in internal self-determination elections in other situations, such as the West Bank and Gaza, Western Sahara and East Timor. Secondly, the status of the settlers is legitimised in addition by permitting large numbers of them to stay in the north. It goes without saying that in any solution to the dispute, the settlers must be treated in a way which is consistent with international human rights law. As such the position of the settlers is different from that of the substantial number of Turkish troops in occupied northern Cyprus. The presence of such troops in the current situation clearly constitutes an affront to the principles of democracy and human rights and a symbol of aggression and they will need to be withdrawn.

 

  1. Respect for Human Rights

a) The Meaning of the Principle

15.       Respect for human rights requires the government to promote and fully to respect the fundamental rights and freedoms granted to the individuals by international conventions, the European legal order and national constitutions. Human rights play a critical role in international law and in European law. The European Convention on Human Rights binds Cyprus and Turkey. The European Court of Human Rights has held on several occasions that, since 1974, Turkey is directly responsible for continuing violations of basic fundamental rights by occupying the Northern part of Cyprus, by preventing displaced Greek Cypriot citizens from returning to their homes and property or from having access to and enjoyment of them, by not investigating the fate of thousands of still missing persons and by failure to protect freedom of religion and freedom of expression. These decisions, unprecedented in scope and gravity, have still not been fully implemented.[9] Further, the rights enshrined in the European Convention constitute fundamental principles of the European Union, which itself is based upon the principles of liberty, democracy, respect for human rights and rule of law.[10] The European legal order, therefore, both through the European Convention of Human Rights and the acquis communautaire, provides the most stringent and efficient system of protection of human and minority rights worldwide. Moreover, both Cyprus and Turkey are parties to the International Covenant on Civil and Political Rights, article 1 of which lays down the right of self-determination, and to the International Convention on the Elimination of All Forms of Racial Discrimination.

 

b) Annan Plan Deficiencies

16.       Under the Annan Plan, serious restrictions of political and civil rights, of freedom of residence, breaches of the prohibition of racial discrimination and severe violations of property rights and of the right to respect of one’s home would be maintained and even perpetuated for all Cypriot citizens during several decades and in certain cases permanently (eg. freedom to chose one’s residence and the right to return to one’s home). The question of settlers has been addressed above (paragraph 14). The Annan Plan would have prevented the right of all displaced Greek Cypriots from returning to their homes and would have significantly limited the right of Greek Cypriots who own property in the north from recovering their property.[11] Further, the Annan Plan sought to deny the right of recourse to the European Court of Human Rights for property owners deprived of their rights (as determined by the Court) by the expedient of declaring the “United Republic of Cyprus” the appropriate respondent state, and thus absolving Turkey, and stating that existing applications should be struck out on the grounds that under the Plan adequate domestic remedies had been provided for. Parallel to this, Article 6 of Annex IX of the Foundation Agreement contained in the Annan Plan provided that the EU be requested to endorse the plan as accepted by the parties and that this would result in the adoption of primary law. The implication of this would be in essence the prevention of the EU’s Court of Justice from challenging the plan on the grounds of violating the fundamental principles of the EU.

 

  1. Democracy

a) The Meaning of the Principle

17.       Democracy refers to the establishment and continued existence of a genuinely representative government responsive to the people. It requires that the basic rules establishing and organizing the state and its relationship with society be accepted by the citizens. It further requires full respect of the will of the people as expressed by the voters and/or their legitimate representatives. Democracy is founded on majority rule, in full recognition and application of individual, minority and group rights, as appropriate. The principle of democracy is an increasingly important part of international law, and at the very heart of European law. Article 3 of the Statute of the Council of Europe refers to pluralist democracy, respect for human rights and the rule of law as principles of the Council system,[12] while article 6 of the Treaty on European Union declares the principles of liberty, democracy, respect for human rights and the rule of law as founding principles of the Union.[13]

 

b) Annan Plan Deficiencies

18.       The Annan Plan process whereby agreements, constitutions and laws are sought to be imposed on an independent state without being the result of any democratic legislative process or dialogue cannot be consistent with the principle of democracy. Neither can strict reliance on arithmetic equality between two demographically unequal communities.[14] A constitutional and institutional framework that requires mutual consent of the representatives of both ethnic communities on all levels of government and in each one of the three traditional powers (legislative, executive and judiciary) reserves a permanent right of veto to both, majority and minority. Leaving the final decision in case of stalemate to foreign citizens in such critical organs as the Supreme Court and others[15] is in stark contradiction to the principle of democracy.

 

19.       On 24 April 2004, 76% of the voters of the Republic of Cyprus in the government controlled area rejected the Annan Plan. This decision must be accepted by all as a valid exercise of democracy and of the right to self-determination.

 

  1. The Rule of Law

a) The Meaning of the Principle

20.       The rule of law in international law provides that all official activities must be undertaken in a way that is consistent with legal principles. It further means that legal processes must be established and respected in order for legal principles to operate effectively, so that, for example, the principle of due process is critical. As previously noted (paragraph 15), both the Council of Europe and the European Union are founded upon inter alia the principle of the rule of law.

 

21.       There can be no international rule of law in a territory illegally occupied by a foreign power. Indeed, the fact that a member state of the European Union is prevented from exercising its sovereignty over part of its internationally recognised territory challenges the reality of the European rule of law itself.

 

b) Annan Plan Deficiencies

22.       The Annan Plan proposed the replacement of the Republic of Cyprus by a new state that would with great difficulty have been able to provide for a stable government, since instability would have been embedded into it, as noted above. In addition, the restrictions on human rights and the ability to pursue them freely pursuant to the European Convention on Human Rights and under the European Union, and the general principles of international law including those norms derived from international treaties binding on Cyprus (e.g. the International Covenants on Human Rights) would have severely challenged notions of due process and the rule of law.

  

The Way Forward: A Constitutional Convention for Cyprus

23.       Based on the 1960 Constitution, the Republic of Cyprus is the only internationally recognized and legal government of the island. Its accession to the European Union has put it under the protection of the latter, so that any solution of the Cyprus problem must commence with the existing institutions and legal order of the Republic of Cyprus as accepted by its people and internationally legitimised. From here, ways and means must be found to adapt the existing institutions and law adequately, taking into account the will of the people as a whole including all communities, in order to recover democratic rule and full sovereignty in the internationally recognised territory of the Republic.

 

24.       A democratic process of autonomous constitution-making consisting of several steps should enable all the people of Cyprus to overcome the present stalemate and to find means and measures that will eventually bring about re-unification and reconciliation consistent with the fundamental principles noted above. The Constitutional Convention as an instrument of democratic constitution making has been successfully used, particularly in the decolonisation process. Constitution drafting must be integrated in, and not separated from, the democratic political process.

 

25.       A Constitutional Convention for Cyprus, democratically elected or designated so as to reflect appropriately the will of the voters and the aspirations of civil society of the different communities of the island as a whole, should have the sole responsibility for drafting and adopting a new Constitution for Cyprus, building on, and eventually amending or replacing, the existing 1960 Constitution of the Republic of Cyprus.

 

26.       The members of the Constitutional Convention should have complete liberty and responsibility for choosing whatever political system they may prefer, whether presidential, parliamentary or combinations thereof; for finding territorial arrangements by an appropriate decentralization scheme – in regions, districts, communes or whatever – and for shaping procedures that will be able to protect efficiently minority and human rights, in the interest of the people of all the communities in Cyprus. Experts both from within and from outside Cyprus may be asked to give advice and assistance to the Convention or its members. The only legal limits of the Convention’s sovereign constitutional power are strict compliance with European constitutional principles and the acquis communautaire, and international human rights and minority protection standards derived from international law and from the European Convention on Human Rights and other European instruments.[16]

 

27.       The new Constitution as framed by the Convention should be submitted to separate and simultaneous referendums to be held on both parts of the island, according to the April 24, 2004 experience.[17] Only the people of Cyprus can bring about the legitimacy essential for a new beginning. Any solution of the Cyprus problem must be legal and legitimate and must build on the only existing constitutional scheme that is recognized by the European Union and the international community, and that is the 1960 Constitution of the Republic of Cyprus. The procedures regulating the election or designation of the Constitutional Convention, its composition and functioning, as well as the holding of the constitutional referendums will have to be provided for by amendments to the 1960 Constitution. It is further proposed that the Constitutional Convention process take place under European Union auspices.

 

Recommendations

28.       The International Expert Panel seeks a fair and equitable Cyprus settlement that allows the communities to achieve reconciliation and a peaceful and prosperous future. It therefore commends the Fundamental Principles of International and European Law as noted above to all relevant international institutions, including the United Nations, the Council of Europe, the Organisation for Security and Cooperation in Europe, but most particularly to the European Union in the light of the historic opportunity presented to it by the recent accession to membership of the Republic of Cyprus and the opening of accession negotiations with Turkey.

 

29.       The International Expert Panel recommends:

a) The acknowledgement of the aforesaid Fundamental Principles by those parties involved in seeking peace, justice and security in Cyprus.

 

b) The adoption of a Resolution in the European Parliament (and in other pertinent international institutions) reaffirming the Fundamental Principles.

 

c) The establishment in the European Parliament (and in other pertinent international institutions) of a monitoring mechanism by which the conformity of any proposed Cyprus settlement with the Fundamental Principles may be ensured.

 

d) The creation of a Constitutional Convention under European Union auspices and on the basis of the 1960 Cyprus Constitution to bring together the parties directly concerned in order to reach a settlement in conformity with the Fundamental Principles.

 

Conclusion

30.       The accession of the Republic of Cyprus to the European Union has fundamentally changed the internal as well as the external aspects of the Cyprus problem. Greek and Turkish Cypriots have now become citizens of the Union, enjoying the rights and subject to the duties provided for in the European legal order. The Republic of Cyprus is a member state and thus one of the “Masters of the Treaties”.

 

31.       Had the Annan Plan been accepted and implemented before accession, that very accession would have rested on shaky legal grounds, as the Union would have integrated a new member state which would not even have signed the accession treaty, while the Republic of Cyprus, which has signed the treaty, would have ceased to exist. Now that accession has become a reality, the abolition of the Republic of Cyprus through a revised Annan Plan is prevented by the very existence of the European Union.

 

32.       The European Union has the historic opportunity and the special responsibility for promoting a new process of democratic constitution making in Cyprus and for convincing all communities to take part in such a process. In so doing, the European Union would ensure the application of its own principles and values, as well as those of international law generally, within the territory of one of its own member-states.

“1. The Union is founded on the principles of liberty, democracy, respect for human rights and fundamental freedoms, and the rule of law, principles which are common to the Member States.

 

2. The Union shall respect fundamental rights, as guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms signed in Rome on 4 November 1950 and as they result from the constitutional traditions common to the Member States, as general principles of Community law.

1. Εισαγωγικές πληροφορίες και παρατηρήσεις

            Η προσπάθεια αυτή άρχισε στο πλαίσιο της «Επιστημονικής Επιτροπής» που δημιουργήθηκε από το Σωματείο «Πανελλήνια Επιτροπή για Ευρωπαϊκή Λύση στην Κύπρο» που ιδρύθηκε το 2004.             Εξαρχής, κύριος σκοπός ήταν ο περιορισμός των συζητήσεων περί το κυπριακό σε αυστηρά επιστημονικά πλαίσια που θα αποσύνδεαν την ανάλυση του σχεδίου Αναν και τις συζητήσεις για την λύση του κυπριακού ζητήματος από ιδεολογικά, πολιτικά, κομματικά και εθνικά κριτήρια και που θα παρήγαν αντικειμενικές εκτιμήσεις συμβατές με το υποχρεωτικό νομικό κεκτημένο του διεθνούς δικαίου και του ευρωπαϊκού δικαίου. Ο προσδιορισμός αντικειμενικών κριτηρίων είναι εφικτός επειδή η Κυπριακή Δημοκρατία είναι μέλος του ΟΗΕ και της ΕΕ. Τόσο η Κυπριακή Δημοκρατία, επίσης, όσο και όλα τα υπόλοιπα εμπλεκόμενα κράτη δεσμεύονται από τις Υψηλές Αρχές του διεθνούς δικαίου, από τους Καταστατικούς Χάρτες των διεθνών οργανισμών στους οποίους συμμετέχουν και από τις διεθνείς συμβάσεις που αφορούν τα ανθρώπινα δικαιώματα, τα εγκλήματα πολέμου και τα εγκλήματα κατά της ανθρωπότητας.

            Αυτό το πλέγμα σχέσεων και νομικών δεσμεύσεων δημιουργεί για όλα τα εμπλεκόμενα κράτη και για τους αξιωματούχους διεθνών θεσμών –όπως ο ΓΓ του ΟΗΕ, οι πολιτικοί ηγέτες της Ευρώπης και οι Επίτροποι της ΕΕ– ένα απολύτως δεσμευτικό κανονιστικό πλαίσιο (κατά το πλείστον πλήρως ενσωματωμένο στην ενδοκρατική δικαιοταξία των εμπλεκομένων κρατών). Στο σημείο αυτό, ακριβώς, τονίζεται η διάκριση μεταξύ του δεσμευτικού νομικού πλαισίου που δημιουργούν οι διεθνείς συμβάσεις και ζητημάτων που αφορούν ασαφείς γενικές αρχές διεθνούς δικαίου, οι οποίες ενόσω υπάρχουν αίτια πολέμου θα βρίσκονται υπό την αίρεση της ισχύος. Η Κύπρος και η Ελλάδα κατά την διάρκεια της περιόδου 2001-2005, ακριβώς, διέθεταν πολύ μεγαλύτερα περιθώρια πρόταξης θεμιτών, νομίμων και νομιμοποιημένων αξιώσεων εφαρμογής της διεθνούς νομιμότητας. Τόσο οι πολιτικοί επιστήμονες όσο και οι πολιτικοί ηγέτες οφείλουν να γνωρίζουν την διεθνή νομιμότητα και να την προτάσσουν. Εν τούτοις οι πλείστοι δεν το έπραξαν! Γιατί άραγε;

 

2. Επιστημονική συζήτηση και πολιτικός ορθολογισμός

 

Στον λεγόμενο ελληνικό επιστημονικό διάλογο των τελευταίων δεκαετιών, όταν κάποιος ανέλυε τους τομείς της διεθνούς ζωής που επηρεάζονται από τις σχέσεις ισχύος, συνήθως εισέπραττε ανοίκειους χαρακτηρισμούς άσχετους με την ουσία των αναλύσεων του [Για το κατά πόσο τέτοιες άθλιες «δολοφονίες (επιστημονικών) χαρακτήρων» ενδέχεται να υποκινούνταν από έξωθεν κριτήρια και συμφέροντα –σύνηθες σε κοσμοθεωρητικά αδύναμα και πολιτικά εξαρτημένα κράτη– το αφήνω στην κρίση του καθενός. Πολλοί «επιστημονικοί» ρύποι έχουν εκτοξευθεί, πάντως, από ένα ευρύ φάσμα αναλυτών του ακαδημαϊκού και δημοσιογραφικού χώρου της Ελλάδας και του εξωτερικού –συνήθως ξεπεσμένων κοσμοπολίτικων και/ή διεθνιστικών πεποιθήσεων που δημιουργούν προκαταλήψεις υπονομευτικών του επιστημονικού στοχασμού– οι οποίοι για ποικίλους λόγους δεν κατανοούν ή δεν θέλουν να κατανοήσουν την βασική δομή του κόσμου όπως θεμελιώθηκε οντολογικά τους τελευταίους αιώνες. Μερικοί από αυτούς με ιδιαίτερο και με λογικούς όρους ανεξήγητο φανατισμό υποστήριξαν μανιωδώς το σχέδιο Αναν. Το σχέδιο αυτό, εν τούτοις, αναμφίβολα εμπεριέχει την πιο αντιπροσωπευτική εκδοχή των διεθνοφασιστικών και νεοαποικιακών αξιώσεων στο κατώφλι του 21ου αιώνα. Το σχέδιο Αναν όχι μόνο αποτελεί προϊόν αναθεωρητικής-ηγεμονικής χρήσης της ισχύος αλλά επιπλέον παραβιάζει όλα τα κεκτημένα του πολιτικού και νομικού πολιτισμού στις διακρατικές σχέσεις. Ερωτώ: Πως πρέπει να κρίνει κάποιος τους υποστηρικτές αυτού του διεστραμμένου σχεδίου, ιδιαίτερα τους φανατικούς και διαχρονικά αμετανόητους;

            Ένα τέτοιο σοβινιστικό και διεθνοφασιστικό κείμενο νομικά παράνομο και πολιτικά αθέμιτο δεν θα μπορούσε να εφαρμοστεί παρά μόνον αν οι ίδιοι οι ενδιαφερόμενοι το αποδέχονταν ψηφίζοντάς το, γεγονός που εξηγεί τις πρωτοφανείς αφόρητες πιέσεις των ηγεμονικών δυνάμεων και των ντόπιων νεροκουβαλητών –βλ. http://www.ifestos.edu.gr/26.htm και http://www.ifestos.edu.gr/27.htm– επί των κυπρίων από το 2001 μέχρι το 2005. Με αναλύσεις που αγγίζουν τα όρια της «επιστημονικής παραπληροφόρησης» για το περιεχόμενο του σχεδίου αυτού, με πολιτικούς εξαναγκασμούς, με τελεσίγραφα και με εκβιαστικά διλήμματα επιχειρήθηκε ο εξαναγκασμός της κυπριακής λαϊκής κυριαρχίας, χωρίς εν τούτοις αποτέλεσμα, επειδή το ένστικτο επιβίωσης και ο ορθολογισμός της κυπριακής κοινωνίας οδήγησε στην συντριπτική καταψήφισή του στις 24 Απριλίου 2004. Κατά την εκτίμησή μου, οι πιο πάνω στάσεις υπέρ του διεστραμμένου αυτού σχεδίου, αν δεν πρόκειται για απόλυτη εθελοτυφλία ή απόλυτη αγραμματοσύνη, φανερώνουν την πραγματική κοσμοθεωρητική ταυτότητα όσων κατά καιρούς ενδύονται «ιδεαλιστικούς», «μετριοπαθείς» και «ειρηνόφιλους» μανδύες για να επισκιαστεί η πραγματικότητα, δηλαδή η συμφέρουσα για την εκάστοτε επικυρίαρχη-ηγεμονική δύναμη υπονόμευση των θεσμών ελευθερίας των κυρίαρχων κοινωνιών (δηλαδή, η υπονόμευση των κρατικών δομών που εξ ορισμού αποτελούν τον κύριο στόχο των αλληλένδετων ηγεμονικών, διεθνιστικών και κοσμοπολίτικων παραδοχών όλων των αποχρώσεων). Όσοι ενέχονται φανερώθηκαν και εκτέθηκαν παντοτινά και ανεπανόρθωτα. Οι πολιτικοί επιστήμονες είναι επιστημονικά ασυγχώρητοι εάν δεν διακρίνουν την κατάφωρη παραβίαση της διεθνούς νομιμότητας και οι πολιτικοί ηγέτες που δεν την γνωρίζουν ή αμελούν να την επικαλεστούν επιδεικνύουν μεγάλη πολιτική ανευθυνότητα επειδή δεν την προτάσσουν για να στηρίξουν τα νόμιμα, θεμιτά και νομιμοποιημένα συμφέροντα της κοινωνίας που αντιπροσωπεύουν. Σε κάθε περίπτωση, εξ αντικειμένου, η πλειονότητα της μεγάλης μάζας των καλοπληρωμένων ειδικών του διεθνούς δικαίου, του συνταγματικού δικαίου, των ανθρωπίνων δικαιωμάτων και του ευρωπαϊκού δικαίου στην Ελλάδα και στην υπόλοιπη Ευρώπη δεν εκπλήρωσαν το δεοντολογικά υποχρεωτικό γι’ αυτούς έργο ακριβούς και αντικειμενικής αναζήτησης της επιστημονικής αλήθειας αναφορικά με το κρίσιμο αυτό ζήτημα που αφορά την ανθρώπινη ελευθερία, την περιφερειακή σταθερότητα και την διεθνή ειρήνη. Πολλοί σιώπησαν, αρκετοί προτίμησαν να επιδίδονται σε «επιτήδεια ουδέτερα αναμασήματα» άσχετων και ανούσιων ιδεών για «μεταεθνικούς κόσμους» των οποίων η Κύπρος θα αποτελούσε πειραματόζωο και άλλοι προσχώρησαν στο ολισθηρό πεδίο της πολιτικής προπαγάνδας και των ιδεολογικοπολιτικών εκλογικεύσεων υπέρ ενός εξ αντικειμένου διεθνοπολιτικά εγκληματικού και επιστημονικά διεστραμμένου σχεδίου αμιγούς νεοαποικιακής έμπνευσης.

            Όσον αφορά το ευρωπαϊκό κεκτημένο πιο συγκεκριμένα, θα πρόσθετα με νόημα πως μια μεγάλη «στρατιά» «ειδικών για τα ευρωπαϊκά» δεν μπορεί να περιορίζεται μόνο στην είσπραξη τεράστιων χρηματοδοτήσεων επιστημονικά ασήμαντων ζητημάτων και την χρήση βαρύγδουπων τίτλων ή την συχνότατη συμμετοχή σε πλουσιοπάροχα συνέδρια όπου αφθονούν οι πολυτέλειες αλλά σπανίζουν οι επιστημονικού χαρακτήρα αναλύσεις. Τα μέλη αυτής της «στρατιάς» που κινδυνεύει να γίνει πλέον συντεχνία, έχει επιστημονική, δεοντολογική και ηθική υποχρέωση να αναζητά διαρκώς, να θεμελιώνει και να δημοσιοποιεί την επιστημονική αλήθεια (τουλάχιστον αυτή που φαίνεται με γυμνό οφθαλμό).

           

Τα πιο πάνω εξηγούν πλήρως τα αίτια των ακατάσχετων εισροών πολιτικού ανορθολογισμού στον ελλαδικό, κυπριακό και ευρωπαϊκό δημόσιο διάλογο, κάτι που κάποιος θα πρέπει να είναι τυφλός για να μην το παρατηρήσει και εξαιρετικά κυνικός για να μην ανησυχήσει.

 

3. Διεθνής ομάδα ειδικών, η τελική έκθεση και δημόσια επιστημονική συνηγορία

 

Η «Επιστημονική Επιτροπή για μια Ευρωπαϊκή λύση του κυπριακού», πέραν των οικείων αναλύσεων που ήδη δημοσιοποιήθηκαν, συνεργάστηκε με την προαναφερθείσα ομάδα διακεκριμένων επιστημόνων από την υπόλοιπη Ευρώπη, οι οποίοι,  διασώζοντας έτσι την τιμή των ευρωπαίων ειδικών του διεθνούς και ευρωπαίου δικαίου μελέτησε το σχέδιο Αναν και τα κριτήρια που θα καθιστούσαν την λύση του κυπριακού συμβατή με το διεθνές δίκαιο και το ευρωπαϊκό νομικό κεκτημένο. 

            Το κείμενο της ομάδας αυτής δημοσιοποιείται, γεγονός που σημαίνει ότι δεν «ανήκει» μόνο στους ξένους καθηγητές και στην ολιγομελή ομάδα της ελληνικής επιστημονικής επιτροπής αλλά ότι επιπλέον αποτελεί επιστημονικό κεκτημένο στον χώρο των κοινωνικών επιστημών. Αποτελεί οπωσδήποτε κείμενο αναφοράς και βάση περαιτέρω ουσιαστικής συζήτησης για μια βιώσιμη λύση του κυπριακού ζητήματος. Οι πρώτες αντιδράσεις όλων των πολιτικών φορέων της Κύπρου μετά την επίσημη παρουσία του εκεί επιβεβαιώνουν αυτήν την εκτίμηση. Αναμένεται ότι πολλοί ακόμη ακαδημαϊκοί στα υπόλοιπα κράτη της Ευρώπης θα το συνυπογράψουν ή θα το στηρίξουν με αναφορές και περαιτέρω επεξεργασία των θεμάτων που θίγονται. Όσοι έλληνες ακαδημαϊκοί ή ελληνικής καταγωγής ακαδημαϊκοί του εξωτερικού επιθυμούν να το επιδοκιμάσουν μπορούν να αποστείλουν μήνυμα στην διεύθυνση «επιδοκιμάζω-συνυπογράφω την έκθεση της διεθνούς ομάδας ειδικών για μια ευρωπαϊκή λύση του κυπριακου» (κλικ για ανοιγμα ηλεκτρονικής επιστολής) και θα διαβιβαστεί αρμοδίως. Επισημαίνεται ότι δεν πρόκειται για τις συνήθεις ιδεολογικού περιεχομένου λίστες υπογραφών που συχνά κυκλοφορούν στην Ελλάδα αλλά για καταγραφή της επιστημονικής συνηγορίας των ελλήνων ακαδημαϊκών που συμβολίζεται με δημόσια αποδοχή συγκεκριμένων επιστημονικών θέσεων για το υποχρεωτικό διεθνές κανονιστικό πλαίσιο, τις υψηλές αρχές του διεθνούς δικαίου, τις συμβάσεις των ανθρωπίνων δικαιωμάτων και το ευρωπαϊκό νομικό κεκτημένο.

            Τέλος, όσοι συμφωνούν με το επιστημονικό περιεχόμενο του κειμένου που επισυνάπτω, καλούνται να το δημοσιοποιήσουν ευρύτερα στις διευθύνσεις του ηλεκτρονικού τους ταχυδρομείου, στις οργανώσεις ή θεσμούς στους οποίους ανήκουν, σε προσωπικές ή άλλες ιστοσελίδες και σε άλλα μέσα επικοινωνίας.

Πλαίσιο αρχών για μια δίκαιη και βιώσιμη λύση του Κυπριακού με γνώμονα το Διεθνές και Ευρωπαϊκό Δίκαιο

  Προοίμιο

 1.         Ο σκοπός της έκθεσης αυτής, που ετοιμάσθηκε από ένα Διεθνές Συμβούλιο Εμπειρογνωμόνων είναι η αναζήτηση μια δίκαιης διευθέτησης του Κυπριακού, η οποία να προσφέρει ένα ειρηνικό και ευήμερο μέλλον για όλους τους κατοίκους του νησιού. Για να επιτευχθεί κάτι τέτοιο πρέπει να εφαρμοστούν οι πρωταρχικές αρχές του Διεθνούς και Ευρωπαϊκού Δικαίου που αφορούν στην επίλυση διεθνών διενέξεων, συμπεριλαμβανομένων των διενέξεων που αφορούν μέλη της Ευρωπαϊκής Ένωσης. Οι αρχές αυτές βρίσκονται στην καρδιά του Διεθνούς και του Ευρωπαϊκού Δικαίου. Η μη συμμόρφωση προς αυτές τις αρχές μπορεί όχι μόνον να θέσει σε κίνδυνο την επιτυχία οποιουδήποτε σχεδίου επίλυσης, ενσωματώνοντας σε αυτό στοιχεία αντικρουόμενα με το διεθνές δίκαιο και αποδυναμώνοντας την βιωσιμότητά του, αλλά και να αποτελέσει αποσταθεροποιητικό στοιχείο στο μέλλον. Μια πολιτική επίλυση αντίθετη με τις γενικά παραδεδεγμένες αρχές του διεθνούς και ευρωπαϊκού δικαίου μπορεί να αποτελέσει "προηγούμενο" σε άλλες περιπτώσεις διενέξεων με σοβαρές επιπτώσεις για την σταθερότητα της διεθνούς τάξης.

 

2.         Οι θεμελιώδεις αρχές του διεθνούς και ευρωπαϊκού δικαίου προσφέρουν ένα μοναδικό οδηγό και μια μεθοδολογία για την έναρξη και επιτυχή κατάληξη μιας διαδικασίας, η οποία να οδηγεί σε μία διευθέτηση του Κυπριακού μέσα στα πλαίσια ενός νέου και γνήσια Κυπριακού Συντάγματος σύμφωνα με το δικαίωμα της αυτοδιάθεσης. Αυτή η διαδικασία βρίσκεται στον πυρήνα μιας Ευρωπαϊκής λύσης για την Κύπρο η οποία να είναι συμβατή με το Διεθνές και Ευρωπαϊκό Δίκαιο.

 

3.         Η επίλυση του Κυπριακού προβλήματος πρέπει να εξευρεθεί υιοθετώντας και εφαρμόζοντας τις βασικές αρχές πάνω στις οποίες βασίζεται το Διεθνές Δίκαιο και η Ευρωπαϊκή Ένωση. Αυτές είναι, συνοπτικά, η ειρηνική διευθέτηση των διαφορών, η κυριαρχία, ανεξαρτησία και ισότητα των κρατών, η απαγόρευση της επίθεσης και η μη αναγνώριση των συνεπειών της και ο σεβασμός των ανθρωπίνων δικαιωμάτων, της ελευθερίας, της δημοκρατίας και της αρχής του κράτους δικαίου. Τόσο η σημερινή τάξη των πραγμάτων στην Κύπρο, όσο και οι όροι που εμπεριέχονται στο τελευταίο Σχέδιο Αννάν δεν είναι συμβατοί με αυτές τις θεμελιώδεις αρχές. Είναι επίσης αναγκαίο να επιτευχθεί μία λύση η οποία να σέβεται πλήρως την ανάγκη για συμφιλίωση και συνεργασία μεταξύ των κοινοτήτων και όλων των ενδιαφερομένων πλευρών.

 

4.         Η Ευρωπαϊκή Ένωση καλείται να αδράξει αυτή την ιστορική ευκαιρία και να αναλάβει την ειδική ευθύνη της να βοηθήσει ενεργά την δρομολόγηση μιας διαδικασίας εκπόνησης Συντάγματος, η οποία θα επιτρέψει εν τέλει στην Κυπριακή Δημοκρατία, ως κράτος-μέλος, να επανακτήσει πλήρη κυριαρχία και ανεξαρτησία και να εγκαθιδρύσει ειρηνικά μια συνταγματική τάξη σύμφωνα με τις παραπάνω αρχές και βασισμένη στον πλήρη σεβασμό της διαφορετικότητας.

  

Βασικά Δεδομένα

 

5.         Η Δημοκρατία της Κύπρου απέκτησε την ανεξαρτησία της το 1960 δυνάμει μιας σειράς διεθνών συμφωνιών. Εντούτοις, σε αντίθεση με άλλες αποικιακές χώρες που απέκτησαν την ανεξαρτησία τους, η Κύπρος υπόκειντο σε Συνθήκη με προβλέψεις εγγυήσεων υπέρ του Ηνωμένου Βασιλείου, της Τουρκίας και της Ελλάδας. Το 1974 η Τουρκία, επικαλούμενη το πραξικόπημα της Ελληνικής χούντας εναντίον της νόμιμης Κυπριακής κυβέρνησης του Αρχιεπίσκοπου Μακαρίου, εισέβαλε στην Κύπρο και προχώρησε σε κατάληψη του Βόρειου τμήματος της. Αυτή η αρχική ενέργεια εξελίχθηκε σε μια παρατεταμένη και συνεχιζόμενη ακόμη κατοχή, που διαρκεί ήδη πάνω από 30 χρόνια και η οποία έχει προκαλέσει μια σειρά παραβιάσεων των ανθρωπίνων δικαιωμάτων, όπως επιβεβαιώνουν τα όργανα της Ευρωπαϊκής Σύμβασης για τα Ανθρώπινα Δικαιώματα[1]. Από το 1974 η Κύπρος είναι de facto διαιρεμένη στη διεθνώς αναγνωρισμένη Κυπριακή Δημοκρατία και την "Τουρκική Δημοκρατία της Βορείου Κύπρου", μια οντότητα[2] η οποία κηρύχθηκε ανίσχυρη από τις αποφάσεις 541(1983) και 550 (1984) του Συμβουλίου Ασφαλείας του ΟΗΕ και η οποία αναγνωρίζεται και συντηρείται μόνο από την Τουρκία. Ενώ περίπου ο μισός τουρκοκυπριακός πληθυσμός μετανάστευσε μετά τα γεγονότα του 1974, με προορισμό κυρίως το Ηνωμένο Βασίλειο, πάνω από 120.000 Τούρκοι έποικοι ζούνε σήμερα στη βόρεια Κύπρο, μετατρέποντας τους Τουρκοκύπριους σε μειονότητα μέσα στη δική τους κοινότητα. Ο πληθυσμός της Κύπρου σήμερα (χωρίς τους έποικους) είναι 802.500 εκ των οποίων το 80% είναι Ελληνοκύπριοι, το 11% Τουρκοκύπριοι (έναντι 18% το 1974) και 9% Αρμένιοι, Μαρωνίτες, Λατίνοι και ξένοι διαμένοντες στην Κύπρο.

 

6.         Το Σχέδιο Αννάν, όπως παρουσιάστηκε στην τελευταία του εκδοχή από τον Γενικό Γραμματέα του ΟΗΕ στις 31 Μαρτίου 2004, προέβλεπε ένα ομοσπονδιακό κράτος, την "Ενωμένη Δημοκρατία της Κύπρου", αντικαθιστώντας και καταργώντας την υπάρχουσα Κυπριακή Δημοκρατία και ενσωματώνοντας τα κατεχόμενα εδάφη του βορρά. Στις 24 Απριλίου 2004, διεξήχθησαν δυο ξεχωριστά δημοψηφίσματα. Ενώ 65% των Τουρκοκυπρίων και εποίκων ψηφοφόρων στον κατεχόμενο βορρά απεδέχθησαν το Σχέδιο Αννάν, 76% των Ελληνοκύπριων κατοίκων της Κυπριακής Δημοκρατίας το απέρριψαν. Την 1η Μαΐου 2004 η Κυπριακή Δημοκρατία, στο σύνολο της, έγινε κράτος-μέλος της Ευρωπαϊκής Ένωσης. Με ένα Πρόσθετο Πρωτόκολλο στην Συνθήκη Προσχώρησης ανεστάλη προσωρινά η εφαρμογή του κοινοτικού κεκτημένου στην κατεχόμενη περιοχή. Η έναρξη των διαπραγματεύσεων για την ένταξη της Τουρκίας αναμένεται σύντομα.

 

Οι Θεμελιώδεις Αρχές

 

1.      Η Ειρηνική Επίλυση των Διαφορών

 

α)  Η Έννοια της Αρχής

7.         Το Άρθρο 2(3) του Χάρτη των Ηνωμένων Εθνών προβλέπει ότι "Όλα τα μέλη θα διευθετούν τις διεθνείς διενέξεις τους με ειρηνικά μέσα και με τέτοιο τρόπο ώστε να μην διακινδυνεύονται η διεθνής ειρήνη, ασφάλεια και δικαιοσύνη". Κατά συνέπεια, ένας διακανονισμός που θέτει, ή μπορεί να θέσει σε κίνδυνο τη διεθνή ειρήνη και σταθερότητα και δε συμβαδίζει με τα αποδεκτά πρότυπα δικαιοσύνης, δεν μπορεί να είναι συμβατός με τις υποχρεώσεις που απορρέουν από το Χάρτη[3] για όλα τα κράτη.

  β)  Οι ανεπάρκειες του Σχεδίου Αννάν

8.         Οι όροι του Σχεδίου Αννάν στην πραγματικότητα θα ενέκλειαν την αστάθεια στον πυρήνα της επίλυσης του Κυπριακού και θα οδηγούσαν αναπόφευκτα σε αυξημένες τριβές και αποσταθεροποίηση. Αυτό υπογραμμίζεται από τις προβλέψεις σχετικά με τη θέση ξένων υπηκόων (μη Κυπρίων), οι οποίοι θα ασκούσαν αποφασιστικό έλεγχο σε βασικούς τομείς κυβερνητικής δραστηριότητας στην Κύπρο. Παραδείγματα όπου μη-Κύπριοι θα είχαν (σε περίπτωση διαφωνίας μεταξύ ίσου αριθμού Ελληνοκύπριων και Τουρκοκύπριων) αποτελεσματικό έλεγχο φαίνεται να αποτελούν η Επιτροπή Συμφιλίωσης, το Ανώτατο Δικαστήριο με νομοθετική και εκτελεστική εξουσία, η Κεντρική Τράπεζα, το Συμβούλιο Επαναπατρισμού, το Δικαστήριο Περιουσιών και τα όργανα του Συμβουλίου Περιουσιών. Λαμβάνοντας υπόψιν τις εμπειρίες της περιόδου 1960-63, η ανάγκη για σταθερότητα στη διάταξη των κυβερνητικών δραστηριοτήτων είναι κρίσιμη. Επιπλέον, οι παραπάνω αλλοδαποί υπήκοοι δεν θα ήταν δημοκρατικά υπόλογοι προς το λαό της Κύπρου.

 

9.         Οποιαδήποτε διευθέτηση μιας διεθνούς διαφοράς πρέπει να είναι συμβατή με τη δικαιοσύνη. Αυτό επισημαίνεται παρακάτω (παράγραφος 15) σε συσχέτιση με τη θεμελιώδη αρχή του σεβασμού για τα ανθρώπινα δικαιώματα.

 

2.      Η Κυριαρχία, Ανεξαρτησία και Ισότητα των Κρατών

 

α) Η Έννοια της Αρχής

10.       Το διεθνές δίκαιο, καθώς και το δίκαιο της ΕΕ, βασίζεται στην αναγνώριση ανεξάρτητων και κυρίαρχων κρατών. Στις σχετικές αρχές συμπεριλαμβάνονται η υποχρέωση μη-επέμβασης στις εσωτερικές υποθέσεις των κρατών και ο σεβασμός της εδαφικής ακεραιότητας όλων των κρατών[4]. Επιπλέον, το δικαίωμα της αυτοδιάθεσης προβλέπει ότι ενόσω ο λαός ενός κράτους έχει το δικαίωμα να συμμετέχει στη διακυβέρνηση του κράτους αυτού, η ελεύθερη επιλογή του λαού του κράτους, σύμφωνα με τις βασικές διεθνείς και ευρωπαϊκές αξίες, πρέπει να γίνεται σεβαστή σε διεθνές επίπεδο.

 

β) Οι ανεπάρκειες του Σχεδίου Αννάν

11.       Το Σχέδιο Αννάν βασίζεται πάνω στη κατάργηση της νόμιμης και αναγνωρισμένης Κυπριακής Δημοκρατίας. Επιπλέον, το δικαίωμα της επέμβασης στις εσωτερικές υποθέσεις της Κύπρου, το οποίο διατηρούν η Ελλάδα, η Τουρκία και η Μεγάλη Βρετανία ως εγγυήτριες δυνάμεις σύμφωνα με την Ιδρυτική Συνθήκη της 16 Αυγούστου 1960 και το οποίο με το Σχέδιο Αννάν επεκτείνεται έτσι ώστε να συμπεριλαμβάνει την εδαφική ακεραιότητα, την ασφάλεια και την συνταγματική τάξη τόσο της ομοσπονδιακής " Ενωμένης Δημοκρατίας της Κύπρου" όσο και των ομόσπονδων κρατιδίων, αποτελεί σημαντικό περιορισμό της κυριαρχίας και ανεξαρτησίας της Κύπρου και προσβολή της διεθνούς και ευρωπαϊκής έννομης τάξης. Αυτό γίνεται ακόμα πιο αισθητό με την προτεινόμενη δημιουργία μιας Εποπτικής Επιτροπής, αποτελούμενης από αντιπροσώπους των εγγυητριών δυνάμεων, των ομόσπονδων κρατών και του ΟΗΕ, για να επιβλέπει την εφαρμογή της διευθέτησης του Σχεδίου Αννάν και με την δυνατότητα να κάνει συστάσεις. Επιπλέον, το Σχέδιο Αννάν προέβλεπε την μόνιμη αποστρατικοποίηση και τον αφοπλισμό του νέου Κυπριακού κράτους, δημιουργώντας ερωτήματα σχετικά με το δικαίωμα της αυτοάμυνας.

 

12.       Επιπλέον, παρατηρεί κανείς στο σχέδιο Αννάν το δικαίωμα του Ηνωμένου Βασιλείου σε ολοκληρωτική και ανεμπόδιστη πρόσβαση για οποιονδήποτε λόγο στα ύδατα που περιλαμβάνονται μεταξύ των περιοχών των κυρίαρχων βάσεων καθώς και το γεγονός ότι οι διαδικασίες διεθνούς δικαστικής επίλυσης ή επίλυσης μέσω τρίτου διαμεσολαβητή απαγορεύονται ρητά όταν οι διενέξεις αφορούν τις περιοχές των βάσεων. Τέτοιες διαφωνίες θα επιλύοντο από διαμεσολαβητή που θα διόριζαν οι αρχές των βάσεων.

 

3.      Η Απαγόρευση των Πράξεων και Συνεπειών της Επίθεσης

 

α) Η Έννοια της Αρχής

13.       Η απαγόρευση της επίθεσης βρίσκεται στον πυρήνα της διεθνούς έννομης τάξης. Είναι ενσωματωμένη στο ευρύτερο διεθνές δίκαιο[5], στο διεθνές ποινικό δίκαιο[6], και σε αναφορά με συγκεκριμένες καταστάσεις. Η απαγόρευση των συνεπειών της επíθεσης σημαίνει το απαράδεκτο των πλεονεκτημάτων που έχουν αποκτηθεί με τη χρήση παράνομης βίας και βρίσκεται ενσωματωμένη, για παράδειγμα, στον κανόνα αναγκαστικού δικαίου περί της μη απόκτησης περιουσιακού τίτλου που είναι αποτέλεσμα βίας. Σε σχέση με την Κύπρο το Συμβούλιο Ασφαλείας του ΟΗΕ υιοθέτησε τις αποφάσεις 541(1983) και 550 (1984), κηρύσσοντας την υποτιθέμενη "Τουρκική Δημοκρατία της Βορείου Κύπρου" (ΤΔΒΚ) παράνομη και καλώντας όλα τα κράτη να μην την αναγνωρίσουν[7]. Επιπλέον, η εγκατάσταση Τούρκων εποίκων, σε μια προσπάθεια αλλοίωσης της δημογραφίας της νήσου Κύπρου, αντιτίθεται στις αρχές του διεθνούς δικαίου, ειδικά σε όσες είναι σχετικές με την αυτοδιάθεση και τα ανθρώπινα δικαιώματα. Συγκεκριμένα, το Άρθρο 49 της ΙV Σύμβασης της Γενεύης περί Προστασίας των Πολιτών του 1949 ( η οποία επικυρώθηκε από την Κύπρο και την Τουρκία) απαγορεύει σε κατοχική δύναμη τη μεταφορά μέρους του πληθυσμού της στα κατεχόμενα εδάφη. Πρέπει, βέβαια, να σημειωθεί ότι κατόπιν της κατοχύρωσης της θέσης των εποίκων ως παράνομης, θα παραμένει το θέμα του τι θα απογίνει με τους εποίκους και τις οικογένειες τους προς διευθέτηση από τα ενδιαφερόμενα μέρη μέσα στο πλαίσιο μιας συνολικά δίκαιης και λογικής επίλυσης και με τρόπο συναφή προς το διεθνές και ευρωπαϊκό δίκαιο.

 

β) Οι ανεπάρκειες του Σχεδίου Αννάν

14.       Το Σχέδιο Αννάν προέβλεπε τη νομιμοποίηση των πράξεων της «ΤΔΒΚ» και κατά προέκταση της ίδιας της «ΤΔΒΚ». Το Σχέδιο διακήρυττε ότι όλες οι πράξεις οποιασδήποτε αρχής στην νήσο Κύπρο (με την εξαίρεση των περιοχών των Αγγλικών βάσεων) θα αναγνωρίζονταν ως έγκυρες, εκτός αν η υπό εξέταση συγκεκριμένη πράξη ήταν ασύμβατη με το διεθνές δίκαιο, ανεξάρτητα από το ζήτημα της νομιμότητας της σχετικής αρχής. Εξίσου σοβαρό είναι το ότι οι προβλέψεις του Σχεδίου σχετικά με τους Τούρκους έποικους δε φαίνεται να ήταν συμβατές με το διεθνές δίκαιο[8]. Κατ' αρχήν, το Σχέδιο επέτρεπε στους εποίκους να ψηφίσουν στο Τουρκοκυπριακό δημοψήφισμα, παρόλο που οι έποικοι συνιστούν πλέον την πλειοψηφία των κατοίκων του βορρά και παρόλο που με αυτό αναγνωριζόταν με συνταγματική ισχύ μια παράνομη συνέπεια μιας παράνομης επίθεσης. Ο ΟΗΕ δεν έχει δεχθεί εποίκους να ψηφίζουν σε εσωτερικές εκλογές αυτοδιάθεσης σε άλλες περιπτώσεις, όπως στη Δυτική Όχθη και τη Γάζα, στη Δυτική Σαχάρα και στο Ανατολικό Τιμόρ. Κατά δεύτερον, η κατάσταση των εποίκων νομιμοποιείται επιπλέον από το γεγονός ότι επιτρέπεται σε ένα μεγάλο αριθμό από αυτούς να παραμείνουν στο βορρά. Είναι προφανές ότι σε οποιαδήποτε επίλυση οποιασδήποτε διαφοράς, οι έποικοι πρέπει να αντιμετωπίζονται με τρόπο συνεπή προς το διεθνές δίκαιο των ανθρωπίνων δικαιωμάτων. Εκ των πραγμάτων το θέμα των εποίκων είναι διαφορετικό από αυτό του σημαντικού αριθμού Τουρκικών στρατευμάτων στην κατεχόμενη Βόρεια Κύπρο. Η παρουσία τέτοιων στρατευμάτων υπό την παρούσα κατάσταση αποτελεί ξεκάθαρη προσβολή προς τις αρχές της δημοκρατίας και των ανθρωπίνων δικαιωμάτων καθώς και σύμβολο επιθετικότητας. Θα πρέπει να αποσυρθούν.

 

4.      Ο Σεβασμός των Ανθρωπίνων Δικαιωμάτων

 

α) Η Έννοια της Αρχής

15.       Η Αρχή του σεβασμού των ανθρωπίνων δικαιωμάτων απαιτεί η κυβέρνηση να προωθεί και να σέβεται πλήρως τα βασικά ατομικά δικαιώματα και τις ατομικές ελευθερίες που απορρέουν από τις διεθνείς συμβάσεις, την ευρωπαϊκή έννομη τάξη και από τα εθνικά συντάγματα. Τα ανθρώπινα δικαιώματα παίζουν έναν κρίσιμο ρόλο στο διεθνές δίκαιο και στο ευρωπαϊκό δίκαιο. Η Ευρωπαϊκή Σύμβαση για τα Ανθρώπινα Δικαιώματα δεσμεύει την Κύπρο και την Τουρκία. Το Ευρωπαϊκό Δικαστήριο Ανθρωπίνων Δικαιωμάτων έχει υποστηρίξει σε αρκετές περιπτώσεις ότι από το 1974 η Τουρκία είναι άμεσα υπεύθυνη για συνεχείς παραβιάσεις βασικών θεμελιωδών δικαιωμάτων με την κατοχή του βορείου τμήματος της Κύπρου, την παρεμπόδιση εκτοπισμένων Ελληνοκύπριων πολιτών να επιστρέψουν στα σπίτια και στην ιδιοκτησία τους ή να έχουν πρόσβαση σε αυτά και να τα απολαμβάνουν, με την έλλειψη έρευνας για τη τύχη των χιλιάδων αγνοουμένων και με την αποτυχία της να προστατέψει την ανεξιθρησκία και την ελευθερία έκφρασης. Αυτές οι αποφάσεις, των οποίων το εύρος και η βαρύτητα είναι πρωτοφανή, δεν έχουν υλοποιηθεί ακόμη[9]. Επιπλέον, τα δικαιώματα που βρίσκονται ενσωματωμένα στην Ευρωπαϊκή Σύμβαση αποτελούν θεμελιώδεις αρχές της Ευρωπαϊκής Ένωσης, η οποία βασίζεται στις αρχές της ελευθερίας, της δημοκρατίας, του σεβασμού για τα ανθρώπινα δικαιώματα και στο κράτος δικαίου[10]. Η Ευρωπαϊκή έννομη τάξη, κατά συνέπεια, τόσο μέσα από την Ευρωπαϊκή Σύμβαση για τα Ανθρώπινα Δικαιώματα, όσο και μέσα από το κοινοτικό κεκτημένο, μας εφοδιάζει με το πιο αυστηρό και πιο αποτελεσματικό σύστημα προστασίας των δικαιωμάτων του ανθρώπου και των μειονοτήτων διεθνώς. Επιπλέον, τόσο η Κύπρος όσο και η Τουρκία μετέχουν στη Διεθνή Σύμβαση για τα Δικαιώματα του Ανθρώπου και του Πολίτη, της οποίας το άρθρο 1 κατοχυρώνει το δικαίωμα της αυτοδιάθεσης, και στη Διεθνή Σύμβαση για την Εξάλειψη των Φυλετικών Διακρίσεων.

 

β) Οι ανεπάρκειες του Σχεδίου Αννάν

16.       Με το Σχέδιο Αννάν, σοβαροί περιορισμοί πολιτικών και αστικών δικαιωμάτων και της ελευθερίας εγκατάστασης, παραβιάσεις της απαγόρευσης φυλετικών διακρίσεων και έντονες παραβιάσεις δικαιωμάτων ιδιοκτησίας και σεβασμού της κατοικίας, θα διατηρούνταν, ακόμα και θα διαιωνίζονταν, για όλους τους Κύπριους πολίτες και για πολλές δεκαετίες. Σε κάποιες δε περιπτώσεις, ακόμα και μόνιμα (π.χ. σε ότι αφορά το δικαίωμα επιλογής τόπου διαμονής και το δικαίωμα επιστροφής στην κατοικία). Το θέμα των εποίκων έχει αναφερθεί παραπάνω (παράγραφος 14). Το Σχέδιο Αννάν θα εμπόδιζε το δικαίωμα όλων των εκτοπισμένων Ελληνοκύπριων να επιστρέψουν στα σπίτια τους και θα μείωνε σημαντικά το δικαίωμα των Ελληνοκυπρίων οι οποίοι έχουν περιουσία στο βορρά να ανακτήσουν την περιουσία τους[11]. Επιπλέον το Σχέδιο Αννάν επιχειρούσε να αρνηθεί και να καταργήσει το δικαίωμα προσφυγής στο Ευρωπαϊκό Δικαστήριο Ανθρωπίνων Δικαιωμάτων από τους κατόχους περιουσίας οι οποίοι είχαν στερηθεί των δικαιωμάτων τους ( όπως καθόρισε το Δικαστήριο), ανακηρύσσοντας την «Ενωμένη Δημοκρατία της Κύπρου» ως υπεύθυνο αρμόδιο κράτος, απαλλάσσοντας έτσι την Τουρκία και ορίζοντας ότι οι ήδη υπάρχουσες πρόσφυγες θα πρέπει να παραγραφούν με το επιχείρημα ότι με το Σχέδιο Αννάν προβλέπονταν επαρκείς αποζημιώσεις. Παράλληλα, το Άρθρο 6 του Παραρτήματος ΙΧ της Ιδρυτικής Συμφωνίας που περιέχεται στο Σχέδιο Αννάν προέβλεπε να ζητηθεί η επικύρωση του σχεδίου από την ΕΕ, όπως αυτό θα γινόταν αποδεκτό από τα ενδιαφερόμενα μέρη, και η υιοθέτησή του ως πρωτογενούς δικαίου. Κάτι τέτοιο αποσκοπούσε στο να αποκλείσει το Ευρωπαϊκό Δικαστήριο να κρίνει τη συμβατότητα του Σχεδίου με τις θεμελιώδεις αρχές της ΕΕ.

 

5.      Δημοκρατία

 

α) Η Σημασία της Αρχής

17.       Η δημοκρατία αφορά στην εγκαθίδρυση και συνεχή ύπαρξη μιας γνήσια αντιπροσωπευτικής κυβέρνησης υπόλογης στο λαό. Απαιτεί την αποδοχή από τους πολίτες των βασικών κανόνων που διέπουν τη δημιουργία και οργάνωση ενός κράτους και τις σχέσεις του με  τους πολίτες. Απαιτεί επιπλέον τον πλήρη σεβασμό της βούλησης του λαού, όπως αυτή εκφράζεται από τους ψηφοφόρους και/ή από τους νόμιμους αντιπροσώπους τους. Η δημοκρατία βασίζεται στον κανόνα της πλειοψηφίας, με πλήρη αναγνώριση και εφαρμογή των δικαιωμάτων του ατόμου, των μειονοτήτων και των ομάδων, όπως απαιτείται. Η αρχή της δημοκρατίας αποτελεί ένα συνεχώς αυξανόμενης σημασίας μέρος του διεθνούς δικαίου και βρίσκεται στην καρδιά του ευρωπαϊκού δικαίου. Το Άρθρο 3 του Καταστατικού Χάρτη αναφέρεται σε πλουραλιστική δημοκρατία, σεβασμό για τα ανθρώπινα δικαιώματα και το κράτος δικαίου ως αρχές του συστήματος του Συμβουλίου της Ευρώπης[12], ενώ το άρθρο 6 της Συνθήκης για την Ευρωπαϊκή Ένωση διακηρύσσει τις αρχές της ελευθερίας, της δημοκρατίας, του σεβασμού στα ανθρώπινα δικαιώματα και του κράτους δικαίου ως θεμελιώδεις αρχές της Ένωσης[13].

 β) Οι ανεπάρκειες του Σχεδίου Αννάν

18.       Η διαδικασία του Σχεδίου Αννάν, σύμφωνα με την οποία συμφωνίες, συντάγματα και νόμοι επιζητείται να επιβληθούν σε ένα ανεξάρτητο κράτος χωρίς να είναι το αποτέλεσμα μιας δημοκρατικής νομοθετικής διαδικασίας ή διαλόγου, δεν μπορεί να είναι σύμφωνη με την αρχή της δημοκρατίας. Όπως σύμφωνη με την αρχή αυτή δεν μπορεί να είναι ούτε η αριθμητική εξίσωση μεταξύ δυο δημογραφικά άνισων κοινοτήτων[14]. Ένα συνταγματικό και θεσμικό πλαίσιο το οποίο απαιτεί την αμοιβαία συναίνεση των αντιπροσώπων και των δύο εθνοτικών κοινοτήτων σε όλα τα επίπεδα διακυβέρνησης και σε κάθε μία από τις τρεις παραδοσιακές εξουσίες (νομοθετική, εκτελεστική και δικαστική) εξασφαλίζει μόνιμο δικαίωμα αρνησικυρίας (βέτο) τόσο στην πλειοψηφία όσο και στην μειοψηφία. Η μετάθεση της τελικής απόφασης σε ξένους πολίτες σε περίπτωση αδιεξόδου μέσα σε όργανα βαρυσήμαντα όπως το Ανώτατο Δικαστήριο και άλλα[15] βρίσκεται σε πλήρη αντίφαση με την αρχή της δημοκρατίας.

 

19.       Στις 24 Απριλίου 2004 76% των ψηφοφόρων της Κυπριακής Δημοκρατίας στην περιοχή που ελέγχεται από την Κυβέρνηση απέρριψαν το Σχέδιο Αννάν. Αυτή η απόφαση πρέπει να γίνει αποδεκτή από όλους ως μια έγκυρη άσκηση της δημοκρατίας και του δικαιώματος αυτοδιάθεσης.

 

6.      Το Κράτος Δικαίου

 
α) Η Έννοια Της Αρχής

20.       Το κράτος δικαίου στο διεθνές δίκαιο προβλέπει ότι όλες οι επίσημες δραστηριότητες πρέπει να επιχειρούνται με τρόπο συμβατό με τις αρχές του δικαίου. Επίσης σημαίνει ότι νόμιμες διαδικασίες πρέπει να καθιερώνονται και να γίνονται σεβαστές προκειμένου οι αρχές του δικαίου να λειτουργούν αποτελεσματικά, έτσι ώστε, για παράδειγμα, η αρχή της δίκαιης δίκης να είναι ουσιαστική. Όπως έχει σημειωθεί παραπάνω (παράγραφος 15), τόσο το Συμβούλιο της Ευρώπης, όσο και η Ευρωπαϊκή Ένωση βασίζονται μεταξύ άλλων πάνω στην αρχή του κράτους δικαίου.

 

21.       Δεν μπορεί να υπάρξει διεθνής νομιμότητα σε έδαφος παράνομα κατεχόμενο από ξένη δύναμη. Πράγματι, το γεγονός ότι ένα κράτος μέλος της Ευρωπαϊκής Ένωσης εμποδίζεται από την άσκηση της κυριαρχίας πάνω σε μέρος του διεθνώς αναγνωρισμένου εδάφους του θέτει σε αμφισβήτηση την ίδια την Ευρωπαϊκή νομιμότητα.

 

β) Οι ανεπάρκειες του Σχεδίου Αννάν

22.       Το Σχέδιο Αννάν πρότεινε την αντικατάσταση της Κυπριακής Δημοκρατίας με ένα νέο κράτος το οποίο δύσκολα θα μπορούσε να προσφέρει μια σταθερή κυβέρνηση, καθώς θα ενείχε το στοιχείο της αστάθειας, όπως έχει σημειωθεί παραπάνω. Επιπλέον, οι περιορισμοί των ανθρωπίνων δικαιωμάτων και της δυνατότητας ελεύθερης επιδίωξής τους σύμφωνα με την Ευρωπαϊκή Σύμβαση για τα Ανθρώπινα Δικαιώματα και υπό το καθεστώς της Ευρωπαϊκής Ένωσης και των γενικών αρχών του διεθνούς δικαίου, συμπεριλαμβανομένων των κανόνων που απορρέουν από τις διεθνείς συνθήκες που δεσμεύουν την Κύπρο (π.χ. Διεθνείς Συμβάσεις για τα Ανθρώπινα Δικαιώματα), θα προσέβαλλαν σοβαρώς τις έννοιες της ορθής απονομής δικαιοσύνης και του κράτους δικαίου.

  

Ο Δρόμος προς τα Εμπρός : Μια Συντακτική Συνέλευση για την Κύπρο

 

23.       Με βάση το Σύνταγμα του 1960, η Κυπριακή Δημοκρατία είναι το μόνο διεθνώς αναγνωρισμένο και νόμιμο πολιτειακό σύστημα διακυβέρνησης της νήσου Κύπρου. Η ένταξή της στην Ευρωπαϊκή Ένωση την έχει θέσει υπό την προστασία της, έτσι ώστε οποιαδήποτε λύση του Κυπριακού να πρέπει να αρχίζει με βάση τους υπάρχοντες θεσμούς και την έννομη τάξη της Κυπριακής Δημοκρατίας, όπως αυτή είναι αποδεκτή από το λαό της και διεθνώς νομιμοποιημένη. Από εκεί και πέρα πρέπει να βρεθούν πρόσφοροι τρόποι και μέσα για να προσαρμόσουν τους ήδη υπάρχοντες θεσμούς και το δίκαιο, λαμβάνοντας υπόψιν τη βούληση του λαού ως συνόλου περιλαμβάνοντας όλες τις κοινότητες, έτσι ώστε να ανακτηθεί η δημοκρατική βάση και η πλήρης κυριαρχία στο διεθνώς αναγνωρισμένο έδαφος της Δημοκρατίας.

 

24.       Μια δημοκρατική διαδικασία αυτόνομης σύνταξης Συντάγματος, η οποία να συμπεριλαμβάνει διάφορα βήματα, θα επέτρεπε στο λαό της Κύπρου να ξεπεράσει το παρόν αδιέξοδο και να ανακαλύψει μέσα και μέτρα τα οποία τελικά θα οδηγήσουν σε επανασύνδεση και συμφιλίωση σύμφωνη με τις προαναφερθείσες θεμελιώδεις αρχές. Η Συντακτική Συνέλευση ως όργανο δημοκρατικής συντακτικής εξουσίας έχει ήδη χρησιμοποιηθεί με επιτυχία, κυρίως στην διαδικασία αποαποικιοποίησης. Η σύνταξη Συντάγματος πρέπει να εντάσσεται σε δημοκρατικές πολιτικές διαδικασίες και όχι χωρίς αυτές.

 

25.       Μια Συντακτική Συνέλευση για την Κύπρο, είτε δημοκρατικά εκλεγμένη, είτε ορισμένη έτσι ώστε να αντικατοπτρίζει ορθά την βούληση των ψηφοφόρων και την προοπτική διαφορετικών κοινοτήτων όλου του νησιού, πρέπει να έχει την αποκλειστική ευθύνη για την σύνταξη και υιοθέτηση ενός νέου Συντάγματος για την Κύπρο, το οποίο να βασίζεται στο ήδη υπάρχον Σύνταγμα της Κυπριακής Δημοκρατίας του 1960 και το οποίο τελικά να τροποποιεί ή να υποκαθιστά.

 

26.       Τα μέλη της Συντακτικής Συνέλευσης πρέπει να έχουν απόλυτη ελευθερία και ευθύνη ως προς την επιλογή του πολιτεύματος, είτε αυτό είναι προεδρικό, κοινοβουλευτικό, ή ένας συνδυασμός των δύο· ως προς την εξεύρεση εδαφικών διευθετήσεων μέσω ενός κατάλληλου σχεδίου αποκέντρωσης- σε περιοχές, περιφέρειες, κοινότητες ή παρεμφερή- και ως προς την διαμόρφωση διαδικασιών ικανών να προστατεύσουν αποτελεσματικά τα δικαιώματα των μειονοτήτων και των ανθρώπων, προς όφελος του λάου όλων των κοινοτήτων της Κύπρου. Γνωματεύσεις και βοήθεια για την Συνέλευση ή τα μέλη της μπορούν να αναζητηθούν από εμπειρογνώμονες από το εσωτερικό της Κύπρου και το εξωτερικό. Τα μόνα νομικά όρια της κυρίαρχης συντακτικής εξουσίας της Συνέλευσης είναι η αυστηρή συμμόρφωση με τις Ευρωπαϊκές αρχές και το κοινοτικό κεκτημένο, και με τα διεθνή πρότυπα σχετικά με τα δικαιώματα του ανθρώπου και την προστασία των μειονοτήτων που πηγάζουν από το διεθνές δίκαιο και από την Ευρωπαϊκή Σύμβαση για τα Ανθρώπινα Δικαιώματα και άλλα Ευρωπαϊκά θεσμικά μέσα[16]

 

27.       Το νέο Σύνταγμα, όπως θα διαμορφωθεί από τη Συνέλευση, θα πρέπει να υποβληθεί σε ξεχωριστά παράλληλα δημοψηφίσματα , τα οποία θα διεξαχθούν στις δύο μεριές του νησιού, σύμφωνα με την εμπειρία της 24 Απριλίου 2004[17].  Μόνο ο λαός της Κύπρου μπορεί να επιφέρει την νομιμότητα που είναι αναγκαία για μια νέα αρχή. Οποιαδήποτε λύση του Κυπριακού πρέπει να είναι νόμιμη και νομιμοποιημένη και πρέπει να βασίζεται πάνω στη μόνη ισχύουσα συνταγματική βάση που αναγνωρίζεται από την Ευρωπαϊκή Ένωση και από την διεθνή κοινότητα, και αυτό είναι το Σύνταγμα της Κυπριακής Δημοκρατίας του 1960. Οι διαδικασίες που θα ρυθμίζουν την εκλογή ή τον ορισμό της Συντακτικής Συνέλευσης, τη σύνθεση της και τη λειτουργία της, καθώς και την διεξαγωγή των δημοψηφισμάτων για το Σύνταγμα, θα πρέπει να προβλέπονται από τροπολογίες στο Σύνταγμα του 1960. Προτείνεται επιπλέον η διαδικασία της Συντακτικής Συνέλευσης να διεξαχθεί υπό την αιγίδα της Ευρωπαϊκής Ένωσης.

  

Συστάσεις

 

28.       Το Διεθνές Συμβούλιο Εμπειρογνωμόνων αναζητά μια δίκαιη και έντιμη λύση για την Κύπρο, η οποία να επιτρέπει στις κοινότητες να επιτύχουν συμφιλίωση και ένα ειρηνικό και ευήμερο μέλλον.  Κατά συνέπεια συνιστά την τήρηση των Θεμελιωδών Αρχών του Διεθνούς και Ευρωπαϊκού Δικαίου όπως αναφέρονται παραπάνω σε όλους τους αρμόδιους διεθνείς θεσμούς, συμπεριλαμβανόμενου του ΟΗΕ, του Συμβουλίου της Ευρώπης, του Οργανισμού για την Ασφάλεια και τη Συνεργασία στην Ευρώπη, αλλά ιδιαίτερα στην Ευρωπαϊκή Ένωση υπό το πρίσμα της ιστορικής ευκαιρίας που της παρουσιάζεται με την πρόσφατη ένταξη της Κυπριακής Δημοκρατίας και την έναρξη ενταξιακών διαπραγματεύσεων με την Τουρκία.

 

29.       Το Διεθνές Συμβούλιο Εμπειρογνωμόνων συνιστά:

 

α) Την αναγνώριση των παραπάνω Θεμελιωδών Αρχών από τα μέρη τα οποία εμπλέκονται στην αναζήτηση ειρήνης, δικαιοσύνης και ασφάλειας στην Κύπρο.

 

β) Την υιοθέτηση ενός ψηφίσματος από το Ευρωπαϊκό Κοινοβούλιο (και άλλους αρμόδιους διεθνείς θεσμούς)  στο οποίο να επαναβεβαιώνονται οι Θεμελιώδεις Αρχές.

 

γ) Τη σύσταση μέσα στο Ευρωπαϊκό Κοινοβούλιο (και σε άλλους αρμόδιους διεθνείς θεσμούς) ενός εποπτικού μηχανισμού μέσω του οποίου να διασφαλίζεται η συμβατότητα με τις Θεμελιώδεις Αρχές οποιουδήποτε διακανονισμού  προτείνεται για την Κύπρο.

 

δ) Τη δημιουργία μιας Συντακτικής Συνέλευσης υπό την αιγίδα της Ευρωπαϊκής Ένωσης και στη βάση του Κυπριακού Συντάγματος του 1960, η οποία να φέρει σε επαφή τα άμεσα ενδιαφερόμενα μέρη με σκοπό την εξεύρεση μιας επίλυσης συμβατής με τις Θεμελιώδεις Αρχές. 

 

 Συμπέρασμα

 

30.       Η ένταξη της Κυπριακής Δημοκρατίας στην Ευρωπαϊκή Ένωση έχει μεταβάλει  ριζικά τους εσωτερικούς όσο και εξωτερικούς παράγοντες του Κυπριακού.  Ελληνοκύπριοι και Τουρκοκύπριοι είναι τώρα πια πολίτες της Ένωσης, απολαμβάνουν τα δικαιώματα που πηγάζουν από την Ευρωπαϊκή έννομη τάξη και υπόκεινται στα καθήκοντα που πηγάζουν από αυτή.  Η Κυπριακή Δημοκρατία είναι κράτος-μέλος και κατά συνέπεια είναι μία από τους «Κύριους των Συνθηκών».

 

31.       Εάν το Σχέδιο Αννάν είχε γίνει αποδεκτό και είχε τεθεί σε εφαρμογή πριν από την ένταξη, η ίδια η ένταξη θα είχε στηριχτεί σε πολύ ασταθείς νομικές βάσεις, καθώς η Ένωση θα είχε ενσωματώσει ένα νέο κράτος-μέλος το οποίο δεν θα είχε καν υπογράψει τη συμφωνία ένταξης, ενώ παράλληλα η Κυπριακή Δημοκρατία, η οποία θα είχε υπογράψει τη συμφωνία, θα είχε πάψει να υπάρχει.  Τώρα που η ένταξη έχει γίνει πραγματικότητα, η κατάργηση της Κυπριακής Δημοκρατίας μέσω ενός αναθεωρημένου Σχεδίου Αννάν είναι εκ των πραγμάτων αδύνατη λόγω της ύπαρξης της Ευρωπαϊκής Ένωσης. 

 

32.       Η Ευρωπαϊκή Ένωση βρίσκεται αντιμέτωπη με την ιστορική ευκαιρία και την ειδική ευθύνη να προωθήσει μια νέα διαδικασία δημοκρατικής συντακτικής διαδικασίας στην Κύπρο και να πείσει όλες τις κοινότητες να λάβουν μέρος σε αυτή τη διαδικασία.  Κατ’αυτόν τον τρόπο η Ευρωπαϊκή Ένωση  θα εξασφάλιζε την εφαρμογή των δικών της αρχών και αξιών, καθώς και αυτών του διεθνούς δικαίου γενικότερα, μέσα στα εδάφη ενός κράτους-μέλους της.

1.   Η Ένωση βασίζεται στις αρχές της ελευθερίας, της δημοκρατίας, του σεβασμού των δικαιωμάτων του ανθρώπου και των θεμελιωδών ελευθεριών και του κράτους δικαίου, αρχές οι οποίες είναι κοινές στα κράτη μέλη.

2.   Η Ένωση σέβεται τα θεμελιώδη δικαιώματα, όπως κατοχυρώνονται με την Ευρωπαϊκή Σύμβαση για την Προστασία των Δικαιωμάτων του Ανθρώπου και των Θεμελιωδών Ελευθεριών, που υπογράφηκε στη Ρώμη στις 4 Νοεμβρίου 1950, και όπως προκύπτουν από τις κοινές συνταγματικές παραδόσεις των κρατών μελών, ως γενικές αρχές του κοινοτικού δικαίου.

3.   Η Ένωση σέβεται την εθνική ταυτότητα των κρατών μελών της.

4.   Η Ένωση διαθέτει τα μέσα που απαιτούνται για την επίτευξη των στόχων της και για την επιτυχή εφαρμογή των πολιτικών της.

LE COMITE POUR UNE SOLUTION EUROPEENNE A CHYPRE

 

Une base de principes pour une solution juste et viable du problème chypriote à la lumière du Droit International et Européen

 

Préambule

1.         Le but de ce rapport, préparé par un Panel International d’Experts, est la recherche d’une solution juste pour le problème chypriote en vue d’un futur pacifique et prospère pour tous les habitants de l’île. Pour atteindre ce but, on doit appliquer les principes fondamentaux du Droit International et Européen qui sont appliqués lors de l’arrangement des conflits concernant les membres de l’Union Européenne. Ces principes se trouvent au cœur du Droit International et Européen. Le manque du respect de tels principes peut éventuellement non seulement nuire le succès d’un plan particulier d’arrangement en intégrant des éléments contradictoires au Droit International et par conséquent affaiblir sa viabilité, mais aussi constituer un élément d’instabilité pour le futur. Le précédent d’un arrangement politique contraire aux principes qui sont admis par le par le Droit International et Européen peut bien être invoqué à d’autres situations conflictuelles ayant de graves conséquences  pour la stabilité de l’ordre international.

2.         Les principes fondamentaux du droit international et Européen offrent un guide unique et une méthodologie pour commencer et conclure avec succès un processus qui conduira à une solution du problème chypriote dans le cadre d’une nouvelle et authentique Constitution Chypriote en accord avec le droit à l’autodétermination. Cela constitue le noyau d’une solution européenne pour Chypre, conforme au Droit International et Européen.

3.         La solution du problème chypriote doit être trouvée  en respectant et appliquant les principes  fondamentaux sur lesquels ont été fondés le Droit International et l’Union Européenne. Ils sont en bref, le règlement pacifique des différends, la souveraineté, l’indépendance et l’égalité des Etats, l’interdiction de l’agression et la non-reconnaissance de ses conséquences ; le respect des droits de l’homme, de la liberté, de la démocratie et de l’Etat de droit. Le présent statut de Chypre et les dispositions du Plan Annan ne sont pas conformes à ces principes fondamentaux. Il est également essentiel d’arriver à une solution qui respecte pleinement le besoin de réconciliation et de coopération entre les deux communautés et toutes les parties concernées.

 4.         L’Union Européenne est appelée à saisir cette occasion historique et à assumer sa propre responsabilité pour contribuer activement à la mise en marche d’un processus d’élaboration constitutionnelle qui permettra finalement à la République de Chypre, comme pays membre, de récupérer sa pleine souveraineté et indépendance et d’établir d’une manière pacifique un ordre constitutionnel respectant les principes ci-dessus mentionnés et se basant sur le respect absolu de la diversité.

 Données de base

 5.         La République de Chypre acquiert son indépendance en vertu d’une série d’accords internationaux. Pourtant, contrairement à d’autres territoires décolonisés, elle a été régie par les prévisions du Traité de garanties  en faveur du Royaume Uni, de la Turquie et de la Grèce. En 1974 la Turquie, invoquant le coup d’Etat de la junte grecque contre le gouvernement légal de l’Archevêque Macarios, a procédé à l’invasion et l’occupation du Nord de Chypre. Toutefois, cette action initiale s’est transformée en une occupation prolongée et continue qui dure déjà plus de trente ans et qui a entraîné une série de violations des droits de l’homme, comme il a été attesté par les organes de la Convention Européenne des Droits de l’Homme.[1] Dès 1974, Chypre est divisée de facto en deux parties : la République de Chypre reconnue par la communauté internationale et la « République Turque de Chypre du Nord » (RTCN), une entité 2 déclarée nulle par les Résolutions 541(1983) et 550 (1984) du Conseil de Sécurité de l’ONU et reconnue et soutenue seulement par la Turquie. Tandis que presque la moitié de la communauté chypriote-turque a émigré par la suite des événement de 1974, surtout vers le Royaume Uni, plus de 120.000 colons turcs vivent actuellement au Nord de Chypre, transformant les turco-chypriotes en une minorité dans leur propre territoire. La population actuelle de Chypre (colons mis à part) compte 802.500 habitants dont 80% greco-chypriotes, 11% chypriotes-turcs (contre 18% en 1974) et 9% Arméniens, Maronites, Latins et ressortissants étrangers.

 6.         Le Plan Annan présenté dans sa version finale par le Secrétaire Général de l’ONU le 31 mars 2004 prévoyait la création d’un Etat fédéral, « La République Unie de Chypre », en remplaçant et abolissant la République de Chypre actuelle et en intégrant les territoires occupés du Nord de l’île. Le 24 avril 2004 deux référendums séparés ont eu lieu. Tandis que 65% des électeurs chypriotes-turcs et des colons de la région occupée du Nord ont accepté le Plan Annan, 76% des électeurs  chypriotes-grecs de la République de Chypre l’ont rejeté. Le 1er mai 2004 la République de Chypre comme un ensemble est devenue Etat membre de l’Union Européenne. Un protocole additionnel au Traité d’adhésion a prévu  la suspension temporaire de l’acquis communautaire dans la région occupée. Les négociations pour l’adhésion de la Turquie vont bientôt commencer.

Les principes fondamentaux

 

1.      Le règlement pacifique  des différends

 

a)  La notion du principe

 

7.         L’article 2 (3) de la Charte des Nations Unies prévoit que « tous les membres vont régler leurs différends internationaux par des moyens pacifique de sorte que la paix, la sécurité et la justice internationales ne soient pas mises en danger ». Par conséquent un arrangement qui met ou pourrait mettre en danger la paix et la stabilité internationales et qui est incompatible avec les standards de justice acceptées ne peut pas être en conformité avec les obligations qui émanent de la Charte 3 pour tous les Etats.

 

 b) Les déficiences du Plan Annan

 

8.         Les termes du Plan Annan comprendraient, en réalité, l’instabilité au cœur d’un règlement du problème chypriote et conduiraient inévitablement à une friction et une déstabilisation croissantes. Cela est souligné par les dispositions concernant la désignation des ressortissants étrangers qui exerceraient un contrôle effectif sur des domaines essentiels des activités gouvernementales à Chypre. Des exemples où des non-chypriotes pourraient (en cas de désaccord entre le nombre égal des chypriotes grecs et turcs ) avoir un contrôle effectif semblent inclure la Commission de Réconciliation, la Cour Suprême investie de pouvoirs législatifs et exécutifs, la Banque Centrale, le Conseil de Rapatriement, la Cour des propriétés et les organes du Conseil des Propriétés. Tenant en considération l’expérience de la période 1960-63, le besoin de stabilité dans l’exercice des activités gouvernementales est crucial. En plus, les ressortissants étrangers ne pourraient pas être démocratiquement comptables à la population de Chypre.

 

 9.         Tout règlement d’un différent international doit également être en accord avec la justice. Ce point est mentionné ci-après (par. 15) en relation avec le principe fondamental du respect des droits de l’homme.

 

 2.      La souveraineté, l’indépendance et l’égalité des Etats

  

a) La notion du principe

 

10.       Le Droit International, comme aussi le Droit de l’U.E., est fondé sur la reconnaissance de l’indépendance et de la souveraineté des Etats. Les principes qui en résultent contiennent les obligations de la non-intervention aux affaires intérieures des Etats et du respect de l’intégrité territoriale de tous les Etats.4 En outre, le droit à l’autodétermination prévoit que puisque la population d’un Etat a le droit de participer à la gouvernance de cet Etat, le choix libre de la population d’un Etat, conformément aux valeurs fondamentales internationales et européennes, doit être respecté au niveau international.

 

 b) Les déficiences du Plan Annan

 

11.       Le Plan Annan se base sur l’abolition de la légitime et reconnue République de Chypre. En plus, le droit de l’intervention aux affaires intérieures de Chypre, réservé à la Grèce, la Turquie et la Grande Bretagne en tant que puissances garantes selon le Traité d’Etablissement du 16 août 1960, est étendu dans le Plan Annan en vue d’inclure l’intégrité territoriale, la sécurité et l’ordre constitutionnel aussi bien de la « République Unie de Chypre » fédérale que des Etats constituants,  constitue une restriction importante de la souveraineté et de l’indépendance de Chypre et un défi pour l’ordre juridique international et européen. Cela a été souligné par la proposition de la création d’un Comité de Surveillance, composé par les représentants des puissances garantes, les Etats constituants et l’ONU, pour surveiller l’application du règlement du Plan Annan, ayant le pouvoir de faire des recommandations. En outre, le Plan Annan prévoit la démilitarisation et le désarmement permanents du nouvel Etat chypriote, soulevant ainsi des questions concernant le droit à l’autodéfense.

 

 12.       De surcroît, on remarque dans le Plan Annan le droit du Royaume Uni au plein et sans encombre accès pour n’importe quelle raison aux eaux maritimes inclues entre les régions des Bases souveraines et le fait que les procédures d’un règlement juridictionnel international ou d’un règlement au moyen d’une partie tierce sont formellement interdites dans le cas où les différends concernent les régions des Bases. De tels différends seraient résolus par un arbitre désigné par les autorités des Bases souveraines.

  

3.      L’interdiction de l’action et des conséquences de l’agression

  

a) La notion du principe

 

13.       L’interdiction de l’agression se trouve au cœur de l’ordre juridique international. Elle est intégrée au Droit International au sens général du terme5, au  Droit Pénal International6 et en combinaison avec des situations spéciales. L’interdiction des conséquences de l’agression signifie le rejet des bénéfices obtenus par l’agression illégale et elle se trouve incorporée, par exemple, dans la règle du jus cogens de la non-acquisition de titre de propriété comme résultat de l’agression. Dans le contexte de Chypre, le Conseil de Sécurité de l’ONU a adopté les résolutions 541 (1983) et 550 (1984) déclarant la soi-disant « République Turque de Chypre du Nord » comme illégale et appelant tous les Etats à ne pas la reconnaître.7 En plus, l’implantation des colons turcs dans un effort de manipuler la démographie de l’île de Chypre s’oppose aux principes du droit international et plus spécialement à ceux qui concernent l’autodétermination et les droits de l’homme. Plus particulièrement, l’article 49 de la Convention IV de Genève pour la Protection des civiles de 1949 (ratifié par Chypre et la Turquie) interdit à une puissance occupante le transfert d’une partie de sa propre population dans le territoire occupé. On devrait noter bien sûr, qu’ayant établi le statut des colons comme illégal, la question du futur des colons et de leurs familles est un sujet à part qui doit être régler par les parties concernées dans le cadre d’une solution globale, juste et raisonnable de façon conforme au Droit International et Européen.

 

 b) Les déficiences du Plan Annan

 

14.       Le Plan Annan prévoit la légitimation des actes de la « RTCN » et l’extension de la « RTCN » elle-même. Le Plan a déclaré que tous les actes de toute autorité sur l’île de Chypre (à l’exception des régions des bases britanniques) devraient être reconnus comme valides sauf si l’acte particulier en considération n’était pas conforme au droit international, indépendamment du statut de l’autorité en question. Egalement graves, les dispositions du Plan en relation avec les colons de Turquie ne semblent pas être conformes au droit international.8 D’abord le Plan a permis aux colons de participer au référendum chypriote-turc, malgré que ceux-ci  constituent déjà la majorité des habitants du Nord et malgré que cela a eu comme résultat la reconnaissance comme puissance constitutionnelle décisive, une conséquence illégale d’une agression illégale. L’ONU n’avait pas accepté le vote des colons aux élections internes d’autodétermination dans d’autres situations, comme le West Bank  et Gaza, le Sahara occidental, et le Timor oriental. En deuxième lieu, le statut des colons est encore plus légitimé par la permission à un grand nombre d’entre eux de rester au Nord. Il est évident que dans toute solution d’un conflit, les colons doivent être traités de façon conforme au droit international des droits de l’homme. Comme telle, la situation des colons est différente de celle du nombre important des troupes turques dans le Nord occupé des Chypres. La présence de telles troupes dans la situation actuelle constitue clairement un affront aux principes de la démocratie et des droits de l’homme et un symbole de l’agression. Elles devront être retirées.

  

 

4.      Le respect des droits de l’homme

  

a) La notion du principe

 

15.       Le respect des droits de l’homme exige que le gouvernement promeuve et respect pleinement les droits et les libertés fondamentaux de l’homme qui émanent des conventions internationales, l’ordre juridique européen et les constitutions nationales. Les droits de l’homme jouent un rôle crucial dans le droit international et dans le droit européen. La Convention Européenne pour les droits de l’homme engage aussi bien Chypre que la Turquie. La Cour Européenne des Droits de l’Homme a soutenu dans plusieurs occasions que, dès 1974 la Turquie est directement responsable des violations continues des droits fondamentaux par l’occupation de la partie du Nord de Chypre, en empêchant les chypriotes-grecs déplacés de retourner à leurs foyers et propriétés ou d’avoir accès à leur jouissance, par le manque d’investigations pour le sort des milliers de personnes encore disparus et par l’échec de la protection de la liberté de la religion et d’expression. Ces décisions dont l’ampleur et la gravité sont sans précédent, ne sont pas encore appliquées.9 En plus, les droits qui sont intégrés à la Convention Européennes constituent des principes fondamentaux de l’Union Européenne, elle-même étant fondée sur les principes de la liberté, de la démocratie, du respect du droit de l’homme et de l’Etat de droit.10  L’ordre juridique européen, par conséquent, à travers tant de la Convention Européenne des Droits de l’Homme que de l’acquis communautaire, fournit le système le plus sévère et le plus effectif pour la protection des droits de l’homme et des minorités à l’échelle mondiale. En outre, tant Chypre que la Turquie sont parties du Pacte International sur les Droits Civils et politiques, dont l’article 1  prévoit  le droit à l’autodétermination et à la Convention Internationale pour l’élimination de toute forme de discrimination raciale.

 

 b) Les déficiences du Plan Annan

 

16.       Selon le Plan Annan des restrictions sérieuses des droits politiques et civiles, de la liberté de résidence, des violations de l’interdiction des discriminations raciales et de graves violations des droits de propriété et du respect du domicile seraient maintenues pour tous les citoyens chypriotes pour plusieurs décennies. Dans certains cas même en permanence (p.ex. en ce qui concerne le droit de choisir le lieu de résidence et le droit du retour au foyer). La question des colons a été susmentionnée (par. 14). Le Plan Annan empêcherait le droit de tous les chypriotes-grecs déplacés de retourner chez eux et limiterait considérablement le droit des chypriotes-grecs possédant des propriétés au Nord de récupérer leur propriété.11 En plus, le Plan Annan   tentait de nier et supprimer le droit du recours à la Cour Européenne des Droits de l’Homme des propriétaires dépourvus des leur droits (comme déterminé par la Cour) déclarant la « République Unie de Chypre » comme Etat responsable et compétant, et ainsi dispensant la Turquie, et stipulant que les recours existants devraient être prescrits étant donnée que le Plan Annan prévoyait des dédommagements suffisants. Parallèlement, l’article 6 de l’Annexe IX du Traité d’Etablissement qui fait partie du Plan Annan prévoyait qu’on demande la ratification du Plan par L’Union Européenne tel qu’il aurait été accepté par les parties concernées, et son adoption comme droit primaire. L’implication de ceci serait en substance un obstacle à ce que la Cour soit saisie du Plan sous l’angle des violations des principes fondamentaux de l’U.E.

  

5.      La démocratie

 

a) La notion du principe

 

17.       La démocratie se réfère à l’établissement et la continuation de l’existence d’un gouvernement authentiquement représentatif responsable devant le peuple. Elle exige que les règles de base qui régissent la création et l’organisation d’un Etat et de ses relations avec la société soient acceptées par les citoyens. Elle exige, en plus, le respect absolu de la volonté du peuple, comme elle s’exprime par les électeurs et/ou leurs représentants légitimes. La démocratie est fondée sur la règle de la majorité, en reconnaissant pleinement et en appliquant dûment les droits de l’individu, des minorités, et des groupes. Le principe de la démocratie est une partie de plus en plus croissante du Droit International et se trouve au cœur du Droit Européen. L’article 3 du Statut du Conseil de l’Europe se réfère à la démocratie pluraliste, au respect des droits de l’homme et à l’Etat de droit comme des principes du système du Conseil,12 tandis que l’article 6 du Traité de l’Union Européenne déclare les principes de la liberté, de la démocratie et du respect des droits de l’homme et de l’Etat de droit comme principes fondamentaux de l’Union Européenne.13

  

b) Les déficiences du Plan Annan

 

18. Le processus du Plan Annan, qui veut imposer à un Etat indépendant des accords, des constitutions et des lois sans qu’elles soient le résultat d’une procédure législative démocratique ou d’un dialogue, ne peut pas être compatible avec le principe de la démocratie. De même, l’équation arithmétique entre deux communautés démographiquement inégales ne peut pas être compatible avec ce principe.14 Un cadre constitutionnel et institutionnel qui requiert le consensus mutuel des représentants des deux communautés à tous les niveaux de gouvernance et pour chacun des trois pouvoirs traditionnels (législatif, exécutif et judiciaire) assure un droit permanent de véto tant à la majorité qu’à la minorité. La désignation de la décision finale à des ressortissants étrangers en cas d’impasse dans des organes de grande importance comme la Cour Suprême et d’autres15 est incompatible avec le principe de la démocratie.

  

19. Le 24 avril 2004 76% des électeurs de la République de Chypre dans la région contrôlée par le gouvernement ont rejeté le Plan Annan. Cette décision doit être acceptée par tous comme un exercice valide de la démocratie et du droit à l’autodétermination.

  

6.      L’Etat de droit

 

a) La notion du principe

 

20.       L’Etat de droit dans le Droit International prévoit que les activités officielles doivent être assumées de manière compatible avec les principes du droit. Cela signifie également que les procédures légales doivent être établies et respectées en vue du fonctionnement effectif des autorités judiciaires, de façon que, par exemple le principe de justice équitable soit essentiel. Comme il a été noté ci-dessus (par. 15), tant le Conseil de l’Europe que l’Union Européenne sont fondés, entre autres, sur le principe de L’Etat de droit.
 

 

21.       L’existence d’un Etat de droit international n’est pas possible sur un territoire illégalement occupé par une force étrangère. En effet, le fait qu’un Etat membre de l’Union Européenne est empêché d’exercer sa souveraineté à une partie de son territoire internationalement reconnue remet en question l’existence elle-même d’Etat de droit Européen.

 

b) Les déficiences du Plan Annan

 

22.       Le Plan Annan a proposé le remplacement de la République de Chypre par un nouvel Etat qui pourrait difficilement offrir un gouvernement stable, puisque l’élément d’instabilité y serait incorporé, comme il a été noté ci-dessus. De surcroît, les restrictions des droits de l’homme et de la possibilité de leur libre poursuite selon la Convention Européenne des Droits de l’Homme, l’Union Européenne et les principes généraux du droit international, y compris des règles qui émanent des Traités Internationaux qui engagent Chypre (p.ex. Pactes Internationaux relatifs aux les Droits de l’Homme), constitueraient un grave défi pour les notions de  justice équitable et de l’Etat de droit.

 

La voie en avant : Une Assemblée Constitutionnelle pour Chypre

 

23.       Selon la Constitution de 1960, la République de Chypre est la seule internationalement reconnue et son gouvernement est le seul gouvernement légal de l’île de Chypre. Son adhésion à l’Union Européenne l’a mise sous la protection de cette dernière, de façon que n’importe quelle solution du problème chypriote doive commencer sur la base des institutions existantes et l’ordre juridique de la République de Chypre comme elle est acceptée par son peuple et internationalement légitimée. A partir de là, des modes et des moyens doivent être trouvés pour adapter d’une manière adéquate les institutions et le droit déjà existants, tenant en considération la volonté du peuple dans son ensemble qui doit inclure toutes les communautés, de sorte que la gouvernance démocratique et la pleine souveraineté au territoire internationalement reconnu de la République soient récupérées.

 

24.       Une procédure démocratique d’établissement autonome d’une constitution qui comprendra plusieurs démarches, permettra au peuple de Chypre de dépasser la présente impasse et découvrir les moyens et les mesures qui conduiront finalement à une re-unification et à une réconciliation conforme aux principes susmentionnés. L’Assemblée Constitutionnelle comme organe d’établissement démocratique de la Constitution a été déjà utilisée avec succès, surtout lors du processus de décolonisation. L’établissement de la Constitution doit être intégré et non pas séparé des procédures politiques démocratiques.

 

25.       Une Assemblée Constitutionnelle pour Chypre, démocratiquement élue, ou désignée, de sorte qu’elle reflète d’une manière appropriée la volonté des électeurs et les ambitions de la société des différentes communautés de l’île dans son ensemble, doit avoir la responsabilité exclusive pour la rédaction et l’adoption d’une nouvelle Constitution pour Chypre, fondée sur, et éventuellement modifiant ou remplaçant, la Constitution existante de 1960 de la République de Chypre.

 

26.       Les membres de l’ Assemblée Constitutionnelle doivent avoir la liberté et la responsabilité entière concernant le choix du système politique, qu’il soit présidentiel, parlementaire ou une combinaison des deux, pour trouver d’arrangements territoriaux par le biais d’un plan convenable de décentralisation –en régions, départements, communautés ou similaires- et l’élaboration des procédures capables de protéger effectivement les droits des minorités et des hommes, en faveur du peuple de toutes les communautés de Chypre. Des experts de l’intérieur de Chypre ou de l’étranger pourraient être sollicités pour conseiller ou assister les membres de l’Assemblée. Les seules limites légales du pouvoir souverain de l’Assemblée Constitutionnelle sont la conformité stricte aux principes constitutionnels européens et à l’acquis communautaire, et aux règles concernant les droits internationaux de l’homme et la protection des minorités qui émanent du droit international et de la Convention Européenne des Droits de l’Homme et d’autres organes européens.16

 

27.       La nouvelle Constitution, comme elle sera élaborée par l’Assemblée, devra être soumise à deux référendums distincts et simultanés, qui auront lieu dans les deux régions de l’île, selon l’expérience du 24 avril 2004. Seul le peuple de Chypre peut apporter la légitimité nécessaire pour un nouveau commencement. Quelle qu’elle soit la solution du problème chypriote elle doit être légale et légitime et se fonder seulement sur le plan constitutionnel existant qui est reconnu par l’Union Européenne et la Communauté Internationale, c’est à dire la Constitution de la République de Chypre de 1960. Les procédures qui régleront l’élection ou la désignation de l’Assemblée Constitutionnelle , sa composition et son fonctionnement, ainsi que le déroulement des référendums pour la Constitution, seront prévues par des amendements de la Constitution de 1960. En plus, on propose que la procédure de l’Assemblée Constitutionnelle soit déroulée sous l‘égide de l’Union Européenne.

 

Recommandations

 

28.       Le Panel International d’Experts recherche une solution juste et équitable pour Chypre, qui permet aux communautés d’atteindre la réconciliation et un futur pacifique et prospère. Par conséquent il recommande les principes fondamentaux du Droit International et Européen comme ils sont susmentionnés  dans toutes les institutions internationales relatives, y compris l’ONU, le Conseil de l’Europe, l’Organisation pour la Sécurité et la Coopération en Europe, et surtout l’Union Européenne étant donnée l’opportunité historique qui lui est présentée par l’adhésion récente de la République de Chypre et le commencement des négociations avec la Turquie.

 

29.       Le Panel International recommande

a) La reconnaissance des Principes Fondamentaux susmentionnés par les parties qui sont impliquées à la recherche de la paix, de la justice et de la sécurité à Chypre.
b) L’adoption d’une résolution par le Parlement Européen (et d’autres institutions compétentes internationales) dans laquelle les principes fondamentaux seront réaffirmés.

c) L’établissement dans le Parlement Européen (et dans d’autres institutions internationales compétentes) d’un mécanisme de surveillance qui assurera la compatibilité avec les Principes Fondamentaux de n’importe quel arrangement proposé pour Chypre.

d) La création d’une Assemblée Constitutionnelle sous l’égide de l’Union Européenne et sur la base de la Constitution de Chypre de 1960, qui mettra en contact toutes les parties intéressées en vue de trouver une solution compatible avec les Principes Fondamentaux.

Conclusion

 

30.       L’adhésion de la République de Chypre à l’Union Européenne a radicalement transformé les facteurs aussi bien interne qu’externes du problème chypriote. Chypriotes-grecs et Chypriotes-turcs sont désormais des citoyens européens, ils jouissent des droits qui émanent de l’ordre légal Européen et ils sont soumis aux devoirs qui en découlent. La république de Chypre est un Etat membre et par conséquent elle est une des « Maîtres des Traités ».

 

31.       Si le Pan Annan était accepté et mis en application avant l’adhésion, l’adhésion elle-même se serait fondée sur des bases juridiques instables, puisque l’Union aurait intégré un nouvel Etat membre qui n’aurait même pas signé le traité d’adhésion, tandis que la République de Chypre, qui aurait signé le traité, cesserait d’exister. Maintenant que l’adhésion est une réalité, l’abolition de la République de Chypre à travers un Plan Annan réformé est en réalité impossible à cause de l’existence de l’Union Européenne.

 

32.       L’Union Européenne a une opportunité historique et une responsabilité spéciale pour promouvoir une nouvelle procédure de rédaction de la Constitution à Chypre et persuader toutes les communautés à participer à ce processus. Ainsi l’Union Européenne assurerait l’application de ses propres principes et valeurs, comme aussi ceux du droit international en général, dans le territoire d’un de ses Etats membres.

Eine prinzipientreue Grundlage für eine gerechte und dauerhafte Regelung des Zypernproblems im Einklang mit dem Völkerrecht und der europäischen Rechtsordnung

Präambel

1.         Die vorliegende Studie, verfasst durch eine internationale Expertengruppe, zielt darauf ab, eine gerechte Zypernregelung zu suchen, die eine friedliche und prosperierende Zukunft aller Inselbewohner zu gewährleisten vermag. Um dies zu erreichen, müssen die Grundsätze des  Völkerrechts und der europäischen Rechtsordnung, die bei der Schlichtung internationaler Uneinigkeiten, einschließlich bei Streitfragen innerhalb der Mitglieder der Europäischen Union angewendet werden, auch hier das Fundament bilden. Diese Grundsätze bilden den Kern des Völkerrechts und der europäischen Rechtsordnung. Sie zu umgehen gefährdet nicht nur den Erfolg jedes Schlichtungsplanes, indem Widersprüche zu Völkerrecht einfach hingenommen werden und damit seine Akzeptanz untergraben wird, sondern setzt auch ein für die Zukunft destabilisierendes Element frei. Der Präzedenzfall einer politischen Regelung, die geltendem internationalen und europäischen Recht widerspricht, kann negative Wirkungen auf andere Konfliktsituationen ausüben und ernsthafte Konsequenzen für die Stabilität der internationalen Sicherheit und Ordnung mit sich bringen. 

2.         Die Grundsätze des Völkerrechts und der europäischen Rechtsordnung bieten eine einzigartige Leitlinie und Methode an, ein Verfahren in Gang zu bringen und erfolgreich durchzusetzen, welches das Zypernproblem mittels der Ausarbeitung einer neuen Verfassung Zyperns durch einen Verfassungskonvent, im Einklang mit dem Selbstbestimmungsrecht der Völker, zu lösen vermag. Dies ist der eigentliche Kern einer europäischen Lösung für Zypern, auf der Grundlage des Völkerrechts und der EU-Rechtsordnung.

 3.        Eine Lösung des Zypernproblems bedingt, dass die Grundsätze, auf welchen das Völkerrecht und die Europäische Union beruhen, anerkannt und auch durchgesetzt werden. Es sind dies die friedliche Regelung von Konflikten, die Souveränität, die Unabhängigkeit und die Gleichheit der Staaten, das Aggressionsverbot und die Achtung der Menschenrechte, der Freiheit, der Demokratie und der Rechtsstaatlichkeit. Sowohl die heutige Situation in Zypern, wie auch und vor allem der Annan Plan widersprechen diesen Grundsätzen diametral. Es muss eine Lösung angestrebt werden, die der Notwendigkeit einer Versöhnung und einer Zusammenarbeit aller Gemeinschaften und aller relevanten Parteien volle Beachtung zollt.

 

 4.        Die Europäische Union wird aufgerufen, diese geschichtlich einzigartige Gelegenheit zu ergreifen und ihrer spezifischen Verantwortung gerecht zu werden, indem sie dazu beiträgt, einen autonomen Prozess der Verfassungsbildung in Bewegung zu setzen, der es der Republik Zypern als EU Mitgliedsstaat ermöglicht, die uneingeschränkte Souveränität und Unabhängigkeit zurück zu gewinnen und eine neue Verfassungsordnung zu schaffen, welche die oben erwähnten Grundsätze respektiert und auf der Achtung der Verschiedenheit beruht.

 

Grundlegende Tatsachen

5.         Die Republik  Zypern erlangte 1960 aufgrund einer Reihe von internationalen Vereinbarungen die Unabhängigkeit.  Im Gegensatz zu anderen dekolonisierten Gebieten war Zypern aber an die Garantieverträge gebunden, die bestimmte Vorrechte des Vereinigten Königreiches, der Türkei und Griechenlands beinhalteten. 1974 besetzte die Türkei, mit Hinweis auf den Putsch der griechischen Militärs gegen die legitime zypriotische Regierung von Erzbischof Makarios, den Nordteil der Insel. Diese Aktion eskalierte jedoch und zog eine langfristige Okkupation nach sich, die nun seit mehr als 30 Jahren andauert und zu einer Unzahl von Menschenrechtsverletzungen geführt hat, die von den Organen der Europäischen Menschenrechtskonvention mehrfach verurteilt wurden[1]. Seit 1974 ist Zypern de facto aufgeteilt in die von der internationalen Gemeinschaft allein anerkannte Republik von Zypern, und in die "Türkische Republik von Nordzypern"[2], ein Gebilde, das durch die UN-Sicherheitsratsbeschlüsse 541 (1983) und 550 (1984) als illegitim bezeichnet wurde und das nur von der Türkei anerkannt und unterstützt wird. Während ungefähr die Hälfte der türkisch- zypriotischen Gemeinschaft seit den Ereignissen von 1974 ausgewandert ist, hauptsächlich nach England, sind bis heute mehr als 120’000 türkische Siedler nach Nordzypern eingewandert und haben so die gebürtigen türkischen Zyprioten zu einer Minderheit in ihrem eigenen Lande werden lassen. Die Bevölkerung von Zypern beträgt zur Zeit (Siedler nicht inbegriffen) 802’500 Menschen, von denen ca. 80% griechische Zyprioten, 11% türkische Zyprioten (1974 waren es 18%) und 9% Armenier, Maroniten, Latiner und andere ausländische Bewohner sind.

6.         Der  Annan Plan, wie er in seiner Schlussversion vom Generalsekretär der Vereinten Nationen am 31. März 2004 vorgestellt wurde, sah eine "Vereinigte Republik Zypern" als einen föderalen Staat vor, der die bestehende Republik Zypern ersetzen und die besetzten Gebiete im Norden der Insel integrieren sollte. Am 24. April 2004 wurden zwei separate Referenden abgehalten. Während 65% der türkischen Zyprioten (inklusive der Siedlerwähler) im besetzten Norden den Annan Plan annahmen, lehnten 76% der griechischen Zyprioten in der Republik Zypern den Plan ab. Am 1. Mai 2004 wurde die Republik Zypern als Ganzes zum Mitgliedsstaat der Europäischen Union. Ein zusätzliches Protokoll zum Beitrittsvertrag sieht die temporäre Aufhebung des „acquis communautaire“ in den besetzten Gebieten vor. Verhandlungen für den EU-Beitritt der Türkei stehen unmittelbar bevor.

Fundamentale Prinzipien

1.  Die friedliche Regelung von Konflikte

a) Allgemeine Bedeutung

7.         Artikel 2 (3) der Charta der Vereinten Nation legt fest, dass "alle Mitglieder ihre internationalen Konflikte mit friedlichen Mitteln lösen sollen, damit der internationale Frieden, die Sicherheit und die Gerechtigkeit nicht gefährdet werden". Dementsprechend kann eine Regelung, die den internationalen Frieden und Stabilität gefährdet, oder zu gefährden droht, und die den geltenden Standards von Gerechtigkeit widerspricht, mit den in der Charta festgelegten Verpflichtungen aller Staaten nicht übereinstimmen.[3]

b) Mängel des Annan-Plans 

8.         Die Umsetzung des Annan Plans hätte die Instabilität zur eigentlichen Grundlage einer Zypernregelung gemacht und unvermeidlich zu verstärkten Reibungen und Destabilisierungen geführt. Dies ergibt sich aus den Bestimmungen, die ausländischen Bürgern eine tatsächliche Kontrolle über Schlüsselbereiche von Regierungstätigkeiten in Zypern zusprachen. Beispiele einer solchen Kontrolle durch Nicht-Zyprioten bei Meinungsverschiedenheit  zwischen den Vertretern der griechischen und türkischern Gemeinschaften sind etwa die Versöhnungskommission, das mit weiten Gesetzgebungs- und Exekutivkompetenzen ausgestattete Oberste Gericht, die Zentralbank, die Umsiedlungsbehörde, das Gericht für Eigentumsfragen, sowie die Organe der Behörde für Eigentumsfragen. Die Erfahrungen der Ereignisse von 1960-63 haben gezeigt, dass die Stabilität der Regierungsordnung von entscheidender Bedeutung ist. Nicht-zypriotische Entscheidungsträger entbehren jeglicher demokratischen Legitimität.  

9.         Jede Regelung eines internationalen Konfliktes muss gerecht sein. Dieser Punkt wird weiter unten (Paragraph 15), im Zusammenhang mit dem Grundsatz der Achtung der Menschenrechte erläutert.

2          Souveränität, Unabhängigkeit und Gleichheit von Staaten

a) Allgemeine Bedeutung

10.       Völkerrecht und EU-Recht basieren auf der gegenseitigen Anerkennung von unabhängigen und souveränen Staaten. Daraus ergeben sich die Verpflichtungen zur Nichteinmischung in die internen Staatsangelegenheiten und zur Achtung der territorialen Integrität aller Staaten[4]. Das Selbstbestimmungsrecht gewährleistet überdies, dass die freie Wahl des Volkes zur Bestimmung der Staatsregierung auf der internationalen Ebene respektiert wird. 

b)  Mängel des Annan-Plans

11.       Der  Annan Plan basiert auf der Auflösung der legitimen und anerkannten Republik Zyperns. Das Griechenland, der Türkei und Großbritannien vorbehaltene Recht zur Intervention in die internen Angelegenheiten Zyperns bleibt so, wie es in den Garantieverträgen vom 16. August 1960 festgelegt ist, erhalten und wird vom Annan Plan gar ausgeweitet auf die Wahrung der territorialen Integrität, der Sicherheit und der verfassungsrechtlichen Ordnung der föderativen „Vereinigten Republik Zypern“ und  ihrer beiden Teilstaaten. Hierin liegt eine entscheidende Einschränkung der Souveränität und Unabhängigkeit Zyperns, sowie eine  Herausforderung für die internationale und europäische Rechtsordnung. Dies ergibt sich aus der vorgeschlagenen Bildung eines Steuerungsausschusses (Monitoring Committee), zusammengesetzt aus Vertretern der Garantiemächte, der Teilstaaten und der UNO, der die Implementierung des Annan Plans zu überwachen und Empfehlungen auszusprechen hätte. Dazu wird im Annan Plan die permanente Entmilitarisierung und Abrüstung des neuen zyprischen Staates vorgesehen, wodurch das Recht zur Selbstverteidigung in Frage gestellt ist.

12.       Zusätzlich gewährleistet der Annan Plan das Recht Großbritanniens zur vollständigen und uneingeschränkten Kontrolle der Gewässer zwischen den „Souveränen Militärstützpunkten“ und schliesst ausdrücklich jegliche Lösung allfälliger Konflikte, die diese Stützpunkte betreffen, durch internationale Gerichts- oder Schiedsgerichtsverfahren aus. Jene Konflikte wären, nach dem Annan Plan, an einen von den Behörden der Souveränen Militärstützpunkte ernannten Schiedsrichter übertragen worden.

3.  Das Verbot der Aggression und ihrer Konsequenzen  

a)  Allgemeine Bedeutung

13.       Das Aggressionsverbot ist der eigentliche Kern der internationalen Rechtsordnung.  Es ist ganz allgemein im Völkerrecht[5], im internationalen Strafrecht[6] und in spezifischen Situationen eingebettet. Die Konsequenzen einer Aggression zu verbieten heisst die durch illegale Aggression geschaffenen Vorteile zu ignorieren. Dieses Verbot ergibt sich zum Beispiel aus der zwingenden Völkerrechtsnorm der Nichtaneignung der durch Aggression besetzten Gebiete. Für Zypern hat der UNO-Sicherheitsrat durch die Resolutionen 541 (1983) und 550 (1984) die "Türkische Republik von Nordzypern" als illegal bezeichnet und die internationale Staatengemeinschaft aufgerufen, sie nicht zu anerkennen[7]. Des Weiteren widerspricht die systematische Implantation türkischer Siedler im Nordteil der Insel, in der Absicht die Demographie der Insel zu manipulieren, den Grundregeln des Völkerrechts, insbesondere dem Selbstbestimmungsrecht und den Menschenrechten. Artikel 49 der Genfer Konvention IV zum Schutz der Zivilpersonen von 1949 (von Zypern und der Türkei ratifiziert) verbietet es der Besatzungsmacht, Teile der eigenen Zivilbevölkerung in besetzten Territorien anzusiedeln. Auch wenn an der Illegalität der Situation der Siedler nicht gerüttelt werden darf, so muss die Frage nach der Zukunft dieser Siedler und ihrer Familien separat im Rahmen einer umfassenden, gerechten und angemessenen Regelung und in Übereinstimmung  mit dem Völkerrecht und dem EU-Recht beantwortet werden.

 

b)  Mängel des Annanplans

14.       Der  Annan Plan sah eine Legitimierung der Akte der "Türkischen Republik Nordzypern" vor, und dehnte diese überdies weiter aus. Der Plan erklärte, dass sämtliche Vornahmen  aller zypriotischen Behörden (ausser den Souveränen Militärstützpunkte) als gültig anerkannt würden, unabhängig von der Frage des Status’ der betreffenden Instanz, es sei denn ein einzelnes Statut stehe im Widerspruch zu Völkerrecht. Ebenso schlimm ist, dass die Vorgaben des Plans bezüglich der türkischen Siedler mit dem Völkerrecht nicht in Einklang zu bringen sind.[8] Zum einen ermöglichte der Plan den Siedlern eine Teilnahme am türkisch-zypriotischen Referendum, obwohl sie heute eine Mehrheit der Einwohner des Nordens bilden und ihnen dadurch, als Folge einer widerrechtlichen Aggression, eine entscheidende verfassungsgebende Gewalt zuerkannt wurde. Die UNO hat das Stimm- und Wahlrecht für Siedler in ähnlichen Situationen, zum Beispiel in Cisjordanien, im Gazastreifen, in der Westsahara oder in Osttimor nie anerkannt. Zweitens ist der Status der Siedler auch insofern legitimiert worden, als einer großen Anzahl davon erlaubt wurde, im Norden zu verbleiben. Zweifelsohne sollten, unabhängig von der Art der Konfliktregelung, die Siedler in einer Weise behandelt werden, die dem internationalen Menschenrechtstandard entspricht. Insofern  unterscheidet sich die Position der Siedler von jener der türkischen Truppen im besetzten Nordteil Zyperns. Die Anwesenheit solcher Truppen in der gegenwärtigen Lage ist ein Rundschlag gegen die Grundprinzipien der Demokratie und der Menschenrechte und ein Symbol der Aggression; sie müssen zurückgezogen werden.

4.  Achtung der Menschenrechte

a) Allgemeine Bedeutung

15.       Der Schutz der Menschenrechte verlangt vom Staat, die den Individuen von internationalen Konventionen, von der europäischen Rechtsordnung und von nationalen Verfassungen gewährleisteten Grund- und Freiheitsrechte zu fördern und umfänglich zu beachten. Menschenrechte spielen eine entscheidende Rolle im internationalen und europäischen Recht. Die Europäische Konvention für Menschenrechte bindet Zypern und die Türkei. Der Europäische Gerichtshof für Menschenrechte hat mehrmals festgestellt, die Türkei trage seit 1974 die unmittelbare Verantwortung für fortgesetzte Verletzungen der Grundrechte, indem sie den Nordteil von Zypern besetzt hält, vertriebene griechische Zyprioten von einer Rückkehr in ihre Häuser und Eigentum abhält, sich weigert, den Verbleib von unzähligen vermissten Personen aufzuklären und es unterlässt, die Religions- und Meinungsfreiheit zu schützen. Diese Entscheidungen, präzedenzlos in Gewicht und Bedeutung[9], sind noch immer nicht umgesetzt worden. Im Weiteren zählen die von der EMRK gewährleisteten Grundrechte und Grundfreiheiten, neben der Freiheit, der Demokratie, der Achtung der Menschenrechte und der Rechtsstaatlichkeit, zu den Grundsätzen auf denen die Europäische Union beruht[10]. Auf der Grundlage der EMRK und des „acquis communautaire“ hat sich die europäische Rechtsordnung zu einem der effizientesten und leistungsfähigsten Systeme zum Schutz der Menschen- und Minderheitsrechte weltweit entwickelt. Zudem sind sowohl Zypern wie die Türkei Vertragsstaaten des Internationalen Paktes über bürgerliche und politische Rechte, dessen Artikel 1 das Recht der  Völker auf Selbstbestimmung proklamiert; beide Länder sind ebenfalls dem Internationalen Übereinkommen zur Beseitigung jeder Form von Rassendiskriminierung beigetreten. 

b)  Mängel des Annan-Plans

16.       Unter dem Annan Plan wären schwerwiegende Beschränkungen der politischen und bürgerlichen Rechte, der Freiheit des Wohnsitzes, Rassendiskriminierungen, Verletzungen des Eigentumsrechts und des Rechts auf Achtung des Heimes fortgesetzt und gar verstärkt worden, und dies für alle zypriotischen Bürger während mehrerer Jahrzehnte, in bestimmten Fällen sogar dauerhaft (z.B. das Recht der freien Wahl des Wohnsitzes und das Recht auf Rückkehr). Der Annan Plan hätte das Recht der vertriebenen Griechischzyprioten auf eine Rückkehr in ihre Häuser in Abrede gestellt und damit den Anspruch aller griechischzypriotischen Hausbesitzer auf Widererlangung ihres Besitzes verneint[11]. Weiter versuchte der Plan, den Eigentümern das Recht eine Beschwerde beim EGMR einzulegen zu enthalten, indem er die „Vereinigte Republik Zypern“ zum verantwortlichen Staat erklärt und damit die Türkei entlastet, und indem er vorsah, hängige Beschwerden seien ungültig zu erklären, da der Plan ausreichende interne Schutzverfahren zur Verfügung stelle. Parallel dazu sah Artikel 6 des Anhangs IX der Grundlagenvereinbarung des Annan Plans vor, dass die EU den Plan, so wie er durch die  Parteien angenommen wurde, zu übernehmen hätte und dass er somit als Primärrecht zu gelten habe. Der Europäische Gerichtshof könnte also den Plan nicht einmal auf seine Vereinbarkeit mit den Grundsätzen der EU-Rechtsordnung überprüfen.

5.  Demokratie

a) Allgemeine Bedeutung

17.       Demokratie bezieht sich auf die Erstellung und Erhaltung eines vom Volk bestimmten und ihm gegenüber verantwortlichen Repräsentativsystems. Die den Staat konstituierenden und seine Beziehungen zur Zivilgesellschaft festlegenden Grundregeln müssen von den Bürgern gewollt und akzeptiert sein. Demokratie erheischt weiter, dass der durch die Stimmbürger und/oder durch ihre legitimen Vertreter bestimmte Volkswille umfänglich beachtet und durchgesetzt wird. Demokratie basiert auf dem Mehrheitsprinzip, in voller Anerkennung der gegebenen Individual-, Minoritäten- und Gruppenrechte. Das Demokratieprinzip nimmt im Völkerrecht stets an Bedeutung zu und kann als der eigentliche Kern der europäischen Rechtsordnung bezeichnet werden. Artikel 3 der Statuten des Europarates erwähnt die pluralistische Demokratie, die Achtung der Menschenrechte und die Rechtsstaatlichkeit als seine Grundprinzipien, während Artikel 6 des Vertrags über die Europäische Union festlegt, dass die Union auf den Grundsätzen der Freiheit[12], der Demokratie, der Achtung der Menschenrechte und Grundfreiheiten, sowie der Rechtsstaatlichkeit beruht[13].

b) Mängel des Annan Plans

18.       Das Vorgehen des Annan Plans, einem unabhängigen Staat Vereinbarungen, Verfassungen und Gesetze aufzuzwängen, die weder auf einem demokratischen Gesetzgebungsverfahren, noch auf einem echten Dialog beruhen, lässt sich mit dem Demokratieprinzip nicht in Einklang bringen. Dasselbe gilt für das Abstellen auf arithmetische Gleichheit zwischen zwei demographisch ungleichen Gemeinschaften[14]. Ein verfassungsrechtlicher Rahmen, der auf allen Staatsebenen und in jeder der drei klassischen Gewalten (Legislative, Exekutive und Judikative) die gegenseitige Zustimmung der Vertreter beider ethnischer Gemeinschaften erfordert, räumt sowohl der Mehrheit wie auch der Minderheit ein dauerhaftes Vetorecht ein. Die endgültige Entscheidung, im Falle einer Pattsituation, fremden Bürgern, in so wichtigen Organen wie zum Beispiel dem Obersten Gericht zu überlassen[15], steht in krassem Widerspruch zu den Grundprinzipien der Demokratie.

19.       Am 24. April 2004 sprachen sich 76% der Wähler der Republik Zypern gegen den Annan-Plan aus. Dieser Entscheid muss als rechtgültige Ausübung der Demokratie und des Rechts auf Selbstbestimmung betrachtet und damit akzeptiert werden.

6.  Rechtsstaatlichkeit

a) Allgemeine Bedeutung

20.       Die rule of law im Völkerrecht setzt voraus, dass alle amtlichen Tätigkeiten in einer Weise vorgenommen werden, die sich mit rechtlichen Grundsätzen vereinbaren lässt.  Sie bedeutet ferner, dass rechtliche Verfahren vorgesehen und beachtet werden müssen, die es ermöglichen, diese rechtlichen Grundsätze effektiv und auf faire Art und Weise durchzusetzen. Wie vorher angeführt (Paragraph 15), beruhen sowohl der Europarat wie auch und die Europäische Union, unter anderem,  auf dem Grundsatz der Rechtsstaatlichkeit.

 21.       In einem illegal durch eine fremde Macht besetzten Gebiet kann es keine völkerrechtskonforme rule of law geben. Die Tatsache, dass es einem Mitgliedsstaat der Europäischen Union verwehrt ist, seine Hoheitsrechte über Teile seines international anerkannten Staatsgebietes auszuüben,  stellt die Realität der europäischen Rechtsstaatlichkeit grundsätzlich in Frage. 

 

B)  Mängel des Annan Plans

22.       Der Annan Plan schlug vor, die Republik Zypern durch einen neuen Staat zu ersetzen, der nur mit großer Schwierigkeit in der Lage gewesen wäre, für eine stabile Regierung zu sorgen, da die Instabilität, wie oben bemerkt, in ihn tatsächlich eingebettet worden wäre. Dazu kommt, dass die Einschränkungen der Menschenrechte und der damit verbundenen Fähigkeit, sie gemäß der EMRK, dem EU-Recht und dem Völkerrecht frei auszuüben, sich mit Due process und Rechtsstaatlichkeit nicht vereinbaren lassen.

 

Der Weg nach Vorne: Ein Verfassungskonvent für Zypern

23.       Auf der Basis der Verfassung von 1960 bildet die Republik Zypern die einzige international anerkannte und legitime Regierung der Insel. Ihr Beitritt zur Europäischen Union hat sie unter deren Schutz gestellt, sodass jede Lösung des Zypernproblems von den vorhandenen Institutionen und dem geltenden Recht der Republik Zypern, wie sie vom Volk angenommen und von der internationalen Gemeinschaft anerkannt wurden, ausgehen muss. Auf dieser Grundlage müssen Wege und Mittel gefunden werden, die bestehenden Institutionen und das Rechtsystem entsprechend dem Willen des gesamtes Volkes und unter Einschluss aller Gemeinschaften anzupassen, um die Demokratie wiederherzustellen und die volle Souveränität über das international anerkannte Gebiet der Republik zurück zu gewinnen.

 24.       Ein demokratischer Prozess autonomer Verfassungsgebung soll es dem ganzen Volk von Zypern schrittweise ermöglichen, die bestehenden Pattsituation zu überwinden und Mittel zu finden, eine Wiedervereinigung und eine Versöhnung in die Wege zu leiten, die mit den oben erwähnten Grundsätzen zu vereinbaren ist. Die Institution des Verfassungskonvents als Instrument demokratischer Verfassungsgebung hat sich namentlich, aber bei weitem nicht nur im Entkolonialisierungsprozess bewährt. Die Ausarbeitung einer Verfassung muss in den demokratischen politischen Prozess integriert, bzw. darf nicht von ihm getrennt werden.

 25.       Die Verantwortung für die Ausarbeitung und die Annahme einer neuen Verfassung Zyperns soll einem Verfassungskonvent übertragen werden, der demokratisch gewählt oder ernannt wird und so dem Wählerwillen und den Erwartungen der Zivilgesellschaft aller Gemeinschaften der Insel vollen Ausdruck gibt. Die neue Verfassung Zyperns soll letztlich die geltende Verfassung der Republik Zypern von 1960 abändern oder ersetzen.

 26.       Den Mitglieder des Verfassungskonvents sollte die völlige Freiheit gewährt und die alleinige Verantwortung übertragen werden für die Wahl des bevorzugten Regierungssystems, ob präsidial, parlamentarisch oder gemischt; für die Erarbeitung territorialer Lösungen durch angemessene Dezentralisierung  - sei es in Regionen, Bezirke, Gemeinden oder was auch immer - und für die Bestimmung von Verfahren, die den Minderheiten und den Menschenrechten den ihnen zustehenden Schutz zu gewähren vermögen, im Interesse der Bevölkerung aller Gemeinschaften von Zypern. Experten vom In- und Ausland können beigezogen werden, um den Konvent oder seine Mitglieder zu beraten und zu unterstützen. Die rechtliche Grenze der verfassungsrechtlichen Souveränität des Konvents liegt in der strengen Achtung der europäischen Verfassungsgrundsätze, des „acquis communautaire“ und der internationalen Menschen-  und Minderheitsrechte, wie sie vom Völkerrecht, von der EMRK und weiteren Übereinkommen gewährleistet werden[16].

 27.       Die vom Konvent ausgearbeitete neue Verfassung Zyperns soll in separaten und in beiden Teilen der Insel gleichzeitig abgehaltenen Referenden dem Volk unterbreitet werden, wie dies am 24. April 2004 geschah[17]. Nur das Volk Zyperns vermag, die für einen Neuanfang erforderliche Legitimität hervorzubringen. Jede Lösung des Zypernproblems muss rechtsstaatlich legitimiert sein und auf jener Grundlage aufbauen, die von der Europäischen Union und von der internationalen Gemeinschaft anerkannt ist: die Verfassung der Republik Zypern von 1960. Die Verfahren bezüglich der Wahl oder der Ernennung des Verfassungskonvents, dessen Zusammensetzung und Arbeitsweise und bezüglich der Abhaltung der Verfassungsreferenden sollen durch Teilrevision der Verfassung von 1960 geschaffen werden. Es wird weiter vorgeschlagen, den gesamten Prozess des Verfassungskonvents unter den Schutz der EU zu stellen.

 Empfehlungen

28.       Die internationale Expertengruppe strebt eine angemessene und gerechte Zypernregelung an, die es den Gemeinschaften erlaubt, sich zu versöhnen und die eine friedliche und prosperierende Zukunft möglich macht.  Sie anvertraut folglich die oben erwähnten Grundsätze des Völkerrechts und der EU-Rechtsordnung allen relevanten internationalen Institutionen, einschließlich den Vereinten Nationen, dem Europarat, der Organisation für Sicherheit und Zusammenarbeit in Europa, aber besonders der Europäischen Union, angesichts der historischen Gelegenheit, die ihr durch den Beitritt der Republik Zyperns und durch die Eröffnung von Beitrittsverhandlungen mit der Türkei aufgegeben ist.

 

29.       Die internationale Expertengruppe empfiehlt : 

a)  Die Anerkennung der erwähnten Grundsätze durch alle beteiligten Parteien, die sich für Frieden, Gerechtigkeit und Sicherheit auf Zypern einsetzen.

 b)  Die Annahme einer Resolution im Europäischen Parlament (und anderen internationalen Institutionen), welche diese Grundsätze nochmals bestätigt. 

 c)  Die Einrichtung eines Steuerungsmechanismus im Europäischen Parlament (und in anderen internationalen Institutionen), um die Übereinstimmung jeder vorgeschlagenen Zypernregelung mit den erwähnten Grundsätzen sicherzustellen. 

 d)  Die Schaffung eines Verfassungskonvents für Zypern unter dem Schutz der Europäischen Union und auf der Grundlage der Verfassung Zyperns von 1960, um die unmittelbar betroffenen Parteien zusammenzubringen und eine mit den erwähnten Grundsätzen vereinbare Regelung sicherzustellen. 

 

Zusammenfassung

30.       Der Beitritt der Republik Zypern zur Europäischen Union hat die internen und externen Aspekte des Zypernproblems grundlegend verändert. Griechische und türkische Zyprioten sind jetzt Bürger der EU und genießen als solche die Rechte und Pflichten, die aus der europäischen Rechtsordnung abgeleitet werden. Die Republik Zypern ist ein EU-Mitgliedsstaat und folglich einer der "Meister der Verträge“

 31.       Wäre der Annan Plan vor dem EU-Beitritt angenommen und durchgesetzt worden, hätte dieser Beitritt auf wackligen Boden gestanden, da die Union einen neuen Mitgliedsstaat integriert hätte, der den Beitrittsvertrag nicht unterzeichnet hätte, während die Republik Zypern, welche den Vertrag unterzeichnet hat, aufgehört hätte zu existieren. Nun da der Beitritt Wirklichkeit geworden ist, wird die Auflösung der Republik Zyperns mittels eines neu aufgelegten Annan Plans allein schon durch das Bestehen der Europäischen Union verunmöglicht. 

 32.       Die Europäische Union hat die historische Chance und trägt die spezielle Verantwortung, einen neuen Prozess demokratischer Verfassungsgebung in Zypern in die Wege zu leiten und zu fördern, sowie alle Gemeinschaften der Insel anzuhalten, sich an diesem Prozess zu beteiligen. In dieser Weise würde die Europäische Union die Anwendung ihrer eigenen Grundsätze und Werte, sowie die des Völkerrechts im allgemeinen, auf dem Gebiet eines ihrer Mitgliedsstaaten sicherstellen. 

 Anhang: Artikel 6 des Vertrags der europäischem Union

 

1.  Die Union basiert auf den Grundsätzen der Freiheit, der Demokratie, der Achtung der Menschenrechte und Grundfreiheiten, sowie der Rechtsstaatlichkeit, Prinzipien, welche allen Mitgliedsstaaten bekannt sind.

 

2.  Die Union achtet die Grundrechte, wie sie in der am 4. November 1950  in Rom unterzeichneten Europäischen Konvention zum Schutz der Menschenrechte und Grundfreiheiten gewährleistet sind und wie sie sich aus den gemeinsamen  Verfassungsüberlieferungen der  Mitgliedsstaaten als allgemeine Grundsätze des Gemeinschaftsrechts ergeben.

 

3.  Die Union achtet die nationale Identität ihrer Mitgliedsstaaten.

 

4.  Die Union ist mit den Mitteln ausgestattet, die zum Erreichen  ihrer Ziele und zur Durchführung ihrer Richtlinien erforderlich sind.
